// Privacy NEWS // Germany Wants To Be Able To Listen Instant Messaging
A draft law provides for the provision of access to decrypted content at the request of law enforcement agencies and after a judge's decision.

According to Der Spiegel magazine, the Minister of the Interior Horst Seehofer wants to legally compel all instant messengers to provide the content of exchanged streams on request, even if they are encrypted end-to-end.
His draft law, which is currently circulating in ministries, requires WhatsApp, Telegram, Signal, Wire and others to be subject to the same obligations as telecom operators. Such access to data would only be provided after a judge's decision. Online services of non-cooperating companies would be banned from operating in Germany.
Germany copies the Anglo-Saxons
With such a draft legislation, Germany is following in the footsteps of other countries that have already passed similar legislation, such as the Assistance and Access Act in Australia (2018), the Investigatory Powers Act in the United Kingdom (2016) or the Anti-Terrorism Act in Russia (2016).
The German draft law does not specify how such access can be implemented, especially in the case of end-to-end encrypted messaging. It is likely that the federal government will be inspired by the ideas of the Australian government.
The latter do not want to break the end-to-end encryption, but to force publishers to establish invisible parallel access, through data synchronization on a device controlled by law enforcement or a phantom member in conversations. (A shame.)
Another difficulty: how to force companies that are not established in the country? Banning a messaging service is much more difficult than you might think. In 2018, the Russian government tried to block Telegram by brutally filtering the IP addresses of its servers.
The operation devastated entire sections of the Russian Web, without succeeding in silencing the Dourov brothers' messaging.
