CAUTION - If you live in the EU this blog posting is illegal???

in #news8 years ago (edited)

According to reuters, a court in the Netherlands as just ruled that linking to content is illegal unless you get the author's consent.

According to the article
Playboy just won a lawsuit...

Content owners argue that the ease with which people can post links to copyrighted material on the internet infringes their rights while internet users say restricting people's ability to post links goes against the principle of freedom of information.

The ECJ recognised that the internet "is of particular importance to freedom of expression and of information and that hyperlinks contribute to its sound operation and to the exchange of opinions and information as well."

The European Commission, the EU executive, is set next week to propose tougher rules on publishing copyrighted content, including a new exclusive right for news publishers to ask search engines like Google (GOOGL.O) to pay to show snippets of their articles.

I haven't visited Europe since my tour of duty in the military. But if you live in the EU, you should be outraged by this. Both the ruling and the plans by your government to require payment for simply linking to content.
This is going to cause a new internet darkage, because search engines aren't going to pay to highlight you. They will simply delete you from their results. You should take action to let your government know that this is going to have major adverse economic impact.

Now the question for steem. Who's copyright laws do we plan to enforce now the ECJ has ruled that linking text and images constitutes copyright infringement as well?

Sort:

We live in Blockchain Jurisdiction.

No laws can be effectively coercive here.

Well you might want to think that. But the reality is it just mean's you'r subject to every nation's laws.
Not you personally but steemit would be. Think of what is happening right now with torrent sites.
All a torrent is, is just a link. This link contains a list of trackers that know where file chunks are at.
Trackers get taken down all the time.

Steemit may be forced to comply with EU law if it doesn't assert some sort of common carrier type of status.
I really don't know how it will play out But countries have never been shy about extending their jurisdiction all the way across the world wide web.

Although I hope we never find out, but we will one day, I must admit I'm curious to see how Dan's belief in the "Non Aggression Principle" will play out if Steemit is confronted by authorities wanting them to turn over information on an individual here on Steemit (be it Name, IP, etc).

I'm going to assume it will go like this ... Steemit is not Dan, Steemit is a company located in the US, and if authorities in the US request a users information and it meets legal requirements, well they're going to hand over whatever they know about the person; be it name, location, IP, etc.

What's really going to be interesting to see is how they will handle a request from a country other than the US if that country tries to say that since the blockchain is decentralized, Steemit somehow also resides in their country as well, and attempt to force Steemit to hand over the information.

Personally I'm not an anarchist, libertarian, voluntarist or anything people tend to label me for simply reblogging others ideas I find interesting. I do like the idea of the NAP and have practiced it my entire life without knowing until the last few years that someone had given the idea of not being an asshole an acronym to sell shirts (lulz).

So, I ask those of you more schooled in these philosophies ... does it violate the NAP for Steemit to give up a users information to a government, which I think most of us agree is coercive by nature? In this scenario, let's assume this user has not initiated any sort of violence towards anyone in their post on Steemit. A government simply wants information because they claim they have violated some law within their country regarding content (posting a link as you mention above for example) or otherwise.

I have a feeling that this is going to turn out to be one of our more epic blog discussions.

The NAP to my mind doesn't provide for any sort of "common defense". If steemit is compelled by law to give away your information then they must do it. If they do not, then they run the risk of losing their own individual freedoms.

It's not a violation of NAP to "give up" someone else. It's a violation to do anything directly to harm them.

I live in the EU and this discussion about this law is going on for more than 2 years now. I don't think it passes the european parliament but if it does every countries parliament would have to implement such a law in the countries law/constitution which would take another two years.

My opinion about linking texts, images and videos? It has to be allowed because I think linking is like quoting - every scientific essay must have directory to the sources used for - its necessary to link in articles relaying on information form different sources.

I am so glad Britain has Brexited!

Not yet we haven't. The process to exit hasn't been started yet, we're still very much part of the EU for the moment. Even when the process to leave has been instigated, it will take at least 2 years to complete.

OKay....you should have the author's permission...that is my natural, instinctual conclusion...but the author should understand they are giving implied consent when posting to the internet, without taking precautions against the spread of the their content. As long as an author's content is identified as theirs within the alt text, I see no harm done to re-posting it, as long as due credit is given. :D Yeah @williambanks?

Well you're close anyways. A link actually IS a direct citation and infact it's the most pure form since it is embedded directly in the context, rather than requiring a footnote. That was pretty much the entire intent behind the hypertext concept. It's also the reason why broken links are so damned annoying. :D @robyneggs

There exsists no such law as copyright. Post all content you want. It is uncensorable!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!! They have to find you first to sue you!

Not us but steemit.

Are you the one who shuts steemit down? You may try.... So far it's up.

That is a legitimate question. Do keep us updated!

I think it's kind of difficult to not link. I use my own pictures for my post so far but if there's is news a info I found online to share, you want to provide the link for people to check out and also so you cannot be plagiarising.

This is crazy internet regulation attempt, not sure if it will ever pass and what consequences
