Bayer Booms After Judge Rules In Favor Of Monsanto

Monsanto is facing countless lawsuits over its weed killer products and mounting accusations that their products have caused cancer for many. Bayer recently saw their shares rise after a judge had delivered a ruling that might limit evidence that plaintiffs would be permitted to present in court during their cases.

They saw at least a 4 percent increase since the news of the ruling surfaced.

It was U.S. District Judge Vince Chhabria who granted the request just this week that would allow for the evidence presented in an upcoming trial to be staggered.

Monsanto was granted the request to have the upcoming trial split into separate phases.

“The order initially bars lawyers for plaintiff Edwin Hardeman from introducing evidence that the company allegedly attempted to influence regulators and manipulate public opinion.

The Hardeman trial is expected to begin at the end of February.

“Under [the new] order, evidence of Monsanto’s alleged misconduct would be allowed only if glyphosate was found to have caused Hardeman’s cancer and the trial proceeded to a second phase to determine Bayer’s liability.

We can expect that Monsanto/Bayer will continue to deny allegations that glyphosate causes cancer and I guess we can expect the lawsuits to continue to grow as well, with victims who argue otherwise, alleging that it was their direct exposure to Monsanto products that contributed to their health problems.

There are over 9,000 lawsuits that the company is facing...

And many are left wondering if the company will ever be found negligent to a reasonable extent; forced to pay remedy to any of the victims. Though, in one recent case they've already been forced to pay over $70 million in damages.

The recent ruling has been seen as a small success for Bayer in the ongoing effort to win the thousands of battles that Monsanto is facing. Those still with pending cases against Monsanto are understandably eager to get to trial. Will any of those families finally get to see the justice that they seek? We'll have to wait and see as those trials unfold.

At least 10 of these trials are expected to begin either in 2019 or 2020.

This will present a groundbreaking opportunity for plaintiffs to finally be able to present critical evidence in front of juries that hasn't been seen before. Many of the plaintiffs are suffering from a myriad of health problems though and they don't have the luxury of time on their side. Some might not live long enough to see any justice.

Thank you @doitvoluntarily for writing about this case. I have two cases in the multidistrict litigation. One man was a very religious rancher who never smoked and did not drink. He died while waiting for justice. He left a wife and two teenage sons. My other client is an athlete who was in great physical shape until cancer showed up. They both sprayed round up on ranches. They had the same history and the same cancer. Non-Hodgkin’s lymphoma. Sooner or later Monsanto will be forced to answer for what they have done. I did not write about this case for fear it would look like I was using Steem to solicit cases. If you know anyone who is affected there is a law firm in St. Louis that is running point on many of these cases. They can be located with a quick Google search.

9 k trials and they have paid out over 70 million? I suppose the shareholders know of the immense evil, consider damages as a standard expense, and aren’t above profiting from the avoidance of justice.

The $70 million was paid on only one case. The original verdict was over $200 million and reduced by the court as excessive. The 9K cases are pending in court, waiting to be tried. It will either result in a mass settlement, like the asbestos cases, or eventual bankruptcy for Monsanto as they try to escape from their responsibility.

Oh wow just for this case! I couldn’t hope hard enough for bankruptcy for this evil empire. If that happens, it will be the death thro expense of legal fees that will kill them rather than the settlements I bet. Oh please!

@doitvoluntarily I do not think they can continue denying for a long time how bad they do their products, 9000 cases can not be invented.
