HELP PROTECT THE COPYRIGHT OF ALL CONTENT CREATORS


If you are a US based content provider, or if you are simply a US resident who supports creativity, you have the unique last-minute opportunity to make a difference, so please read on! Even if you are not US based, the following information should be of great interest to you too. Please read to the end of this article for information that affects us all.

Under US copyright law, your blog, your story, your poem, your painting, your sculpture, your photograph, your music, your film, your choreography, your software and your artworks of all kind are copyright the moment you create them. Only YOU have the right to allow others to use your work. No one has the right to use your work in any way without specific permission from you, or the payment of a royalty fee.

For many years copyright protection groups have been working together to create a new Bill, The Small-Claims Tribunal Bill, which if passed before the end of this month, will allow photographers and all creatives to pursue Copyright Infringement in an easier and less expensive way than the current tedious and expensive process.

So, how can you help all content providers like yourself or your family members or friends? Before the end of April – possibly next week – in the US Senate, H.R. 3945 will be voted on. You can let your Representative know that this Bill is important to you as a creator of content, or to you as a concerned resident who believes that all artists deserve to be paid for their hard work.

If you are a United States resident, a form letter on the The Copyright Alliance Website is just a click away! They have made it so simple to do. All you have to do is enter your zip code, and the form letter urging your politicians to sign the Bill will be sent directly to your House Representative and Senators after you fill in your name, address and email address!

You will see 3 letters you can send. The first one is the one urging your politicians to vote in favor of Bill H.R. 3945; the second one points out to them that you clearly OWN what you create; the third letter urges them to join the Creative Rights Caucus which will help to educate the public and lawmakers about the importance of protecting our rights as creators.

Finally, how does this affect those of you who are non-US based Steemians? Steemit Inc. is a US based website, and as such is subject to US Copyright Law. Being on the Blockchain does not change this fact! Steemit must comply with all US laws governing copyright, so your blog is copyright, and every photograph taken from the web is also protected by copyright. Should this Bill pass, which I hope it does, it will make it far easier for photographers and other artists to go after infringers.

You can't use an image and then just provide a link to where you found the work on the web. Links don't pay photographers' fees! In fact, I make it a point of never Upvoting or Commenting anymore on posts where clicking on the SOURCE leads to a stock image being used on the web - other than sites like Pixabay etc.! I refuse to help someone make money at the expense of another artist, who is getting paid nothing for the usage! It never ceases to amaze me that even some with very high reputations on Steemit, are following this practice and Infringing on Copyright. Even though their content is otherwise superb, I do not Upvote their posts.

In conclusion, I remind all United States Residents to Act Now, and I request that everyone seriously considers Resteeming this post, so that every US resident on Steemit can be informed, and they can have their say!

very good to point this out ,although a lot of people on steemit are hiding behind "decentalised " "no one can touch me " some day it will bite them back.

Steemit Inc. is very much a centralized company, paying taxes in the USA! It may be a website on the decentralized Blockchain, and Steem may be Decentralized, but the website is not!, unless Steemit Inc. is prepared to give us all a share in the company!

Incase you didn't see my other comment above, images are stored on Steemit’s webite- not on the Blockchain! Photographers can request their images be removed via a DMCA notice to Steemit inc. A bit more research shows the images are stired on Clou Servers. Same difference though. They are not on the Blockchain!

thank you for pointing that out , i'm personally aware of that , but 80% of the violaters have no clue .
For most people it's "o i found it on the internet so it must be for free " , i can imagine if you have to make a living from photography it can be hard, for me it's just a hobby .

Many long-time Steemit users are well aware of what they are doing. They provide a link and know that they can't be accused of plagiarism. I have had many discussions with some claiming that it's their right to take my work and the work of others because it is only pixels! Many of those who just don't know, are upright people who will stop when it is pointed out to them that they are infringing on copyright!

This is very interesting, personally I only every use my own photos in my posts, or the occasional gif which is normally from a very old film and I tend to feel gifs are ok if you quote the source you found it from at least. If I need quality images I buy them on Shutterstock which seems to be as good as place as any - do you use anything similar to sell your content?

Thanks. you would still need a license to use a gif unless it is copyright free, It's just a format like jpeg etc. Very old photos and films will be in the Public Domain likely. Copyright in the USA is for life + 70 years!

I've actually been with Getty for many years, but with the advent of the microstock agencies, revenues started to fall, so I diversified. LOL! Yes, I have images with Shutterstock, Adobe and Istock. I also have a few with Dreamstime and Depositphotos. You know you can get some free images at Pixabay and Unspalsh too, right? You have to be careful though, especially with people images, as you have no access to model releases. Occasionally, (surprise! surprise!) there are images on there that have been swiped from elsewhere, and the sites make it clear that it's the end user's responsibility to make sure that they are getting copyright free images.

Thanks for posting. I'm going to go write my reps right now. Although for clarity, the Steem Blockchain is multi-jurisdictional. The juristiction and nexus extends to where there are nodes and copies of the blockchain running. Only posts published through Steemit.com's interface which is hosted on a server in NY is under the laws of NY, USA. Each interface has its own laws, terms, etc. (Busy, Steepshot, etc.) Content posted from interfaces hosted in other countries (Korea, China, African countries, etc.) are subject to their laws - which differ - and their users are only usually educated about their own copyright laws.

I was just talking with a friend of mine in China actually about ecommerce and knockoffs of American copyrights. It's interesting, but they are not as triggered as we are about it because they don't have the religious engraned core belief that copyright is property, only posession.

There really is no international law on copyright. Although it is helpful to us in the USA when dealing with users in countries where the convention is agreed upon.

I only clarify because just as we can ALL use our stake how we see fit and downvote this and that, technically, some people have as much right to not respect our laws when they are not in our country or using things in our country- such as using their own internet connection, or connecting to a blockchain.

I think this clarity is important as Steem evolves since many apps and smt apps will be developed and are already developed or developing. In addition, those companies may have licenses we users are unaware of. For example, dtube (like youtube) can get a music license to have copyright music in their videos. If that happens, will copyright crusaders using steemit consider if a post is made by dtube before downvoting it for copyright infringement? We shall see.

Important to open dialog about the future of steem blockchain development and how things will be dealt with as far as international use- I'm sure sites like Facebook have similar issues. However, since FB is located only in the US and centralized with one database interface it's so much easier to manage. Not so for Steem Blockchain- in fact, it's more like a mini version of the entire internet. And that has many things still not worked out as far as law, nexus, juristiction, right/wrong, etc.

Of course we will always protect our own copyright. I will protect my own. But I have some empathy and understanding for the difficulties ahead.

I also agree about stock photos- that's why I always use cc0, pd, or my own. I strongly believe what goes around comes around.

Thanks for your input! Steem, the currency may be decentralized, but Steemit Inc. is Centralized. One of the top 50 witnesses posted a great article last year about Steemit Inc.’s vulnerability should there be a lawsuit regarding copyright. They are duty bound legally to abide by DMCA notices, and have already done so in the past. Photography is not stored on the Blockchain. It is stored on Steemit’s website and can be removed when ordered to do so by Steemit Inc. 😊

Some more research shows the imsges are on Cloud Servers, not the website itself of course. The good thing for photographers is that they are definitely not on the Blockchain!

Thanks. I appreciate that. I hope you learned something from it though, because many of the images you are using in your own posts are copyright stock images from the web. If you want to use an image that is not your own, you should be using Pixabay or Unsplash. Copying and linking to anything else on the web unless you have a right to use it is what I am fighting against.
