California Pediatrician Gets Probation Over Vaccine Exemption For 2-Year-Old
Dr. Robert Sears is a pediatrician from Orange County and he's also a well-known vaccine skeptic. Just recently, the Medical Board of California reached a settlement with Dr. Sears, for his actions in writing a court opinion letter which would exempt a 2-year-old boy from receiving childhood immunizations.
As a result of the settlement, Dr. Sears will be placed on probation, required to take education courses and an ethics class. He will also be monitored by a fellow doctor be to sure that he is practicing within the standard of care.
It's alleged that Dr. Sears had written his exemption for the child without having obtained the proper medical history before he made the decision to do so. He allegedly had simply taken the mother's word for it, when she had said that her son had a negative reaction to previous vaccinations.
On his Facebook page however, Dr. Sears admitted that at the time he visited with the mother, the medical records weren't available and that they would've taken over a year to obtain. That was going to take too long, and he says that the mother needed the letter for an upcoming hearing. He notes that she was worried that a judge at the time would force her to resume vaccinations for her child.
Dr. Sears has denied any wrongdoing
He also isn't the only doctor that's being investigated over vaccine exemptions. It's alleged that dozens of other complaints have also been filed against doctors in the state. They too have allegedly been writing illegitimate exemptions.
Dr. Sears says that he is tired of being quiet, he isn't staying silent anymore, and that he will continue to fight against mandatory vaccination laws.
Informed Consent + Free Choice
Patients expect that they will be able to trust their healthcare providers and if that trust is eroded between the two parties, then that is going to negatively impact the service that can be provided.
Dr. Sears hopes that eventually all parents will receive full, unaltered, objective information about the risks that are involved with both getting vaccinated and with failing to get vaccinated. He also admitted that he believed the investigation over the written court opinion letter, stemmed from a conflict that he had with a certain California legislator who he says has made it their personal endeavor to aggressively pursue doctors in the state who are excusing patients from vaccines.

Wow...and Dr Sears is world-renowned for his books and topics. I'm sure there will a huge backlash from his supporters? But then again, you're putting in a fight with the government who ultimately makes the decision. I'm glad in the state of Florida where I live, we can still sign the Religious Exemption form to excuse our children from vaccines for school reasons.

Odd, why would it take a year to get medical records? That part doesn't settle to well with me.
I can completely understand his stance. Informed consent is of the utmost importance, sadly I don't think that we are ever fully informed or as we should be.
to clarify, he says that the medical records weren't available at the time that they were needed for the court opinion, eventually though they did end up getting those records and he admits it did take them over year to be obtained.
I know he spoke with the mom and that should always be a good source (in normal circumstances) . I still just can't fathom the idea it would take a year to get them for a 2yr old. Even if the child was born out of country. With how the exchange of information especially with medical records in not just Cali but the whole country, it wouldn't take that long unless the mom procrastinated or there was a court hold on the records.
That's one brave doctor, and I truly hope more of those will stand up for the patients rights instead of being sheep for big pharma :(
