PROTECTING YOUR PARENTAL RIGHTS - THE KEY TO KEEP CPS AWAY FOR EVER!!!

in #familyprotection6 years ago (edited)

The first post that I made about Parentalrights.org I told you about the proposed Parental Rights Amendment!

"The proposed Parental Rights Amendment will specifically add parental rights in the text of the U.S. Constitution, protecting these rights for both current and future generations."

Previously the right of the parent was established in court cases and there was no need for such an amendment.

Ninety years ago the Supreme Court declared that
“the child is not the mere creature of the State; those
who nurture him and direct his destiny have the
right, coupled with the high duty, to recognize and
prepare him for additional obligations.” Pierce v.
Society of Sisters, 268 U.S. 510 (1925).

This line of reasoning was continued by the Court in the case Wisconsin v. Yoder, 406 U.S. 205 (1972).

This was the pronouncement in that case that the:

primary role of the parents in the upbringing of their children is now established beyond debate as an enduring American tradition.

Unfortunately that debate was re-opened in 2000.

When the U.S. Supreme Court reviewed the law in Troxel v. Granville (2000), a Washington state undermined parental rights by this finding:
It was stated that a good parent's decision about visitation rights can be overridden by a third party simply by claiming it would be in the "best" interest of the child.

There were six separate opinions and none reached a five-vote majority.

  • Justice Scalia held that parents have no
    constitutionally protected rights whatsoever.
  • Only Justice Thomas clearly stated that parental
rights receive the same high legal standard of
    protection as other fundamental rights

This court decision seriously undermined the support for a high-view of parental rights.

This decision caused that several federal courts:

refuse to treat parental rights as deserving of protection as a fundamental right.

So that is why this Amendment is so urgent and so very important.

THE GOOD NEWS!!!

This is actually the reason why I started to made this post. Parentalrights.org engaged at a special Lobbying day at the Capitol on 27 June 2018.

From Wednesday 27 June - 29 June 2018, Parental rights.org visited D.C. to speak to Congress on your behalf, urging their support for the Parental Rights Amendment. If there is one thing that all Americans should agree on is that children should not be separated from their parents unless that child is in real danger. That was the message that parentalrights.org took to Capitol Hill.

The good news is that a new co-sponsor came onboard and the number of co-sponsors reached 21!!!

Ken Calvert (CA-42) is now a cosponsor of H.J. Res. 121, the Parental Rights Amendment, in the U.S. House. With lead sponsor Randy Hultgren (IL-14), Calvert brings to 21 the total number of supporters in that chamber.

Parentalrights says that Congress has been very busy as always and it took Rep. Calvert a whole three weeks to sign on. So they are very hopeful that other members may also sign on soon as they maybe just haven't found the time to do so yet!!! Every co-sponsor that signs on is a breakthrough in the fight to get this Amendment through.

unquestionably friend, I am in agreement with you, as we investigate the issue of cps we can learn about them and the things they are able to do to benefit, sincerely personally I am increasingly surprised how far they are able to get these people, and the injustice and harm they cause to children. Thanks for sharing

Thanks for showing where some of the defining moments happened on this slippery slope. It is important to know these things, as well as those responsible for pushing these horrible laws onto us.

Thank you for your comments. I also learn these things as I dig deeper into the subject.
Before I opened this post I was just thinking I wonder how many South African's live in total poverty. I googled the figure:

Pretoria - More than half of SA’s population is living in poverty, data from Statistics South Africa revealed.
According to the Poverty Trends Report for 2006 to 2015, 30.4 million people (55.5% of the population) is living in poverty. This is up from the 53.2% or 27.3 million people reported in 2011.

So half the population of South Africa would lose their children as some of these families struggle to give one filling (not necessarily nutrious) meal a day. Lots of schools have feeding schemes to provide just that one meal a day. The poverty stricken parents just do the best they can but does not mean that they do not love and care for their children. The social services in South Africa would only intervene in real cases of child neglect (like leaving small kids at home alone) and child abuse. (physical and sexual).
