Sued For YELP Review (Another Reason Crypto Is So Important)

in #lawsuit6 years ago

If you are from another country besides the United States this might seem extra insane to you but a Doctor in New York sued a former patient for $1 Million dollars for writing a bad YELP review against his practice.

It is insane for people in the United States to hear it as well but we hear these insane stories often enough that it somewhat becomes common place. Anyone can sue anyone for any reason. It doesn't mean they will win or get anywhere with it but oftentimes because of the speed of the legal system people are getting sued for all types of reason even though the person who filed the lawsuit knows that they will never win in trial if it got that far. Most cases don't get to trial.

The person or company with more money will file a frivolous lawsuit just to get the other person really scared and they know that the common person will be tapped out real fast. $5,000, $10,000, or $20,000 in legal fees to hire a lawyer to file stuff in defense of the lawsuit.

At that point the common person will sit in the closet and eat gallons of ice cream for comfort and agree to whatever the person filing the lawsuit wants.

What I Think This Woman Should Do

A civil suit like this could go on for years. She likely can't afford to keep paying these legal fees forever. She has done the right thing by going to the media because now the story has been picked up and this doctor is looking like a real rat bastard for this stunt. Now it is out of hand for him. If she plays her cards right then his million dollar lawsuit could turn into him paying her.

She could likely get legal aid for free at this point either through a crowd funding campaign or a law firm might represent her and file a counter complaint saying that the doctor has now defamed her and harassed her and has tried to quash her freedom of speech. New York has anti SLAPP laws.

A strategic lawsuit against public participation (SLAPP) is a lawsuit that is intended to censor, intimidate, and silence critics by burdening them with the cost of a legal defense until they abandon their criticism or opposition.

Yeah that doctor is a fucking moron. Like I said if she plays her cards right he will be paying her.

Step 1 - File the counter claim for $10 Million with counts such as harassment, Intimidation, fraudulent misrepresentation, civil fraud ......etc. Also demand a jury trial.

Step 2 - Blog about it, tweet about it, keep talking to the news. Become a champion for freedom of speech.

Step 3 - Keep reaching out to the rat bastards lawyer with mock settlement drafts where the doctor pays her $500,000 and the lawsuits will get dismissed.

Step 4 - Keep filing tons of shit for her counter claim to spend way more money than he intended on spending on the stupid lawsuit.

Step 5 - At this point the tables will have been turned and he will realize that he is the one that is going to have to tap out or his business will go under and he will spend all his money on legal fees.

Where Does Crypto Come In?

Well it likely doesn't apply in this scenario but if you get hit with some frivolous lawsuit you have to realize that there are a few main ways that a person or company can collect if they somehow win some big judgment against you. Let's say they were paying the judge or something or the lawyers were buddies with the judge.

Real Estate, Vehicles, Bank Accounts, Wage Garnishment

If it looks like the lawsuit isn't going your way then you could sell any real estate. For vehicles you can lease them or have them own under some other trust or business entity not tied to your personal identity. For bank accounts you could keep very minimal amounts in there just to pay off bills. Wage garnishment.......psssshhhhh. You don't have a job. You are full time in crypto.

Won't they seize your crypto? No because you get hacked every other day like @trevonjb and @craig-grant

Really when it boils down to it they won't be able to collect on you and you can just live in the crypto world. You could even get your land lord to accept crypto. Oh you want to own a house. Maybe you can own one through a trust or some other company like you are doing your vehicle.

A lot of states are homestead states so you can keep a certain amount of equity in a property and a vehicle that is worth a certain amount. If things get really bad and they are trying to collect another option could be to file for bankruptcy.

The Reason Why The Bitconnect Civil Lawsuits Won't Go Anywhere

A lot of people didn't like the fact that I was saying that in a couple of videos but none of these guys who were promoters own anything. Everything is leased or rented and they get hacked and lose control of their funds all the time so as long as they keep their crypto hidden no one is going to be able to touch them as far as that stuff is concerned.

The lawyers might try to gain control of their CoinBase and Gemini accounts. Oh guess what..... now they are cashing out through an ATM or through Wall of Coins or Local Bitcoins.

Does anyone remember Big Vern who ran Cryptsy? Do you think that lawsuit is going to go anywhere. He peaced out and is in China or something now.

Let's say Big Vern, Craig Grant, and Trevon James are shady characters....... well you can still take things out of their playbook and realize that these civil lawsuits are a disruption potentially but it doesn't slow people down who live outside the system.

People who are Bitty Rich barely need traditional banking, they don't need a traditional job, and they have the resources to own nothing but control everything when it comes to real estate and vehicles.

If you are presented with a frivolous lawsuit you have to realize what the person is actually after and what their strategy is. Some of this stuff is better off not even answering if you are living the Bitty Rich crypto dream. With this woman's lawsuit if she didn't answer it would be unlikely that the Rat Bastard Doctor would be able to prove even $1 worth of damage so there would either be a small judgment against her or none at all and then if there was a judgment they would have to got through the process of trying to collect which wouldn't be easy either.

Honestly same thing with the Bitconnect lawsuits. If the defendants don't answer it would be real hard to actually prove that the promoters are a fault of anything because they didn't create the system and can claim to be victims of the collapse as well. And if they do get a judgment against them well they don't own anything and they lost it all in the 20 hacks that happened to them.

What is the best outcome for the Rat Bastard Doctor? Loses all his patients? Has to move to California and change his name? Has to pay her $200,000 to shut up?

I hope the women gets a good amount of money; it's what she deserves after this incident. It's outrageous that you can't even write an honest review.

It is pretty unbelievable and especially since there are the anti SLAPP laws to deter people doing these frivolous lawsuits but evidently it doesn't stop everyone from filing and going through a mess like that.

The rat bastard should pay up please...
Funny the way legal system runs freely over there... Actually it's a good thing cus some common people get to have a major of good justice .. but for every good thing, there are disadvantages and that's the abuse of it...
Over here in my country, you can't just go and sue someone.. LMAO... The system takes too much time and you'll just get bored with it and the possibilities that the rat doctor will win the case will be high over here cus probably he has more money than the poor lady...lol...
What amazed me is the way you outlined step by step what the lady should do to win the case and how you connected it with crypto, you've really got the brains @ Phobos

Over here people are really into these court case shows and even the small claims court stuff goes on TV for people's entertainment. It is pretty insane.

Lmao....
Yea!!, Judge Judy right?...
LoL...
I know her on TV, I watch some of her court cases... Some of them are just too funny and the way she handles the cases too...

We are living in a backwards ass, common sense lacking, sue everyone society right now. While I agree that this story is ridiculous, people need to be very careful with their phrasing of things.

For example you probably can't say this Dr is a scammer, but you can say I felt scammed and it's my opinion they probably have a policy of scamming the shit out of people.

Or I believe this guy to be a fraud, its my opinionthis guy is a fraud.

I think as long as you stress something is your opinion your pretty much in the clear.

I didn't have a chance to re-read what she wrote but I recall when I intially read it something she said seemed like she was inferring things about other peoples experience with the doctor which she had no way of knowing. By no means do I think this is a legit lawsuit its ridiculous but knowing the world we live in gotta watch your words carefully

Yeah I get you and It is a good practice like you said to say "in my opinion" ....etc.

It was funny because during the whole Bitconnect thing people rando Shitconnecters were commenting on my YouTube videos that Trevon James can sue me for defamation.....etc. What a joke...lol

Of course all those inbreds went away when everything imploded.
