Government Forcing Dairy Farmer To Confuse His Customers

Randy Sowers and his wife co-own a dairy farm in Maryland, South Mountain Creamery, and they say that the government is trying to force them to confuse their customers. This is because of the way that the government wants Randy to label his milk products.

Right now, Randy is making skim milk that's pasteurized but doesn't have any added chemicals in the mix.

And according to the FDA, a product can only be labeled as skim milk if there have been synthetic vitamins added.

Randy doesn't do this, so the government wants him to label his products as imitation skim milk, or imitation milk.

He insists that there isn't anything imitation whatsoever about his milk products and when people see that on the shelves, imitation milk product, he worries that they won't know what to think.

And if you had the option between an imitation milk product (without added synthetic chemicals) and a skim milk product (with added chemicals) which would you likely choose?

A lawsuit has now been launched against the FDA.

Randy is arguing that they are violating his First Amendment rights by forcing him to submit to their labeling scheme.

Lawyers representing the case insist that the government is trying to force Randy to lie about his products and insisting that their actions are creating unnecessary confusion for people in the market.

At the end of the day, Randy says that he only wants to be able to sell the purest, most natural skim milk possible and he doesn't want to have to submit to the confusing labeling requirements.

Too many government employees looking for things to do.

My big question though is why? What really is the rationale behind this? If you could do a post explaining this I would really appreciate it. Interesting article a part two would be icing on the cake.

This is really a perfect demonstration of how pathologically Orwellian American government has become. If you adulterate your product like Monsanto, you can call it pure. If you don't, you have to call it imitation.

It's also exactly why government has no place in regulating product labeling, testing, or any such thing. Private companies would need to compete for business doing such things, and such egregious failures would quickly doom any company that did it in a competitive market for that service.

Wow, more government Idiocracy.

That's terrible. Soon there will be no more independent farmers because of all the regulation. We should be going the other way. I for one, want real food.

And it gets even worse when you know about Monsanto. Seeds and their genes move across crops naturally. Therefore every now and then a common farmer will end up with some genetically modified gene by Monsanto in his/her crops. Next thing he/she knows, Monsanto is in their front door threatening to sue them for using their patented stuff. The farmer does not have the capital to handle a sue, and ends up agreeing to buy and plant the Monsanto seeds...

Monsanto has seized many farms by this exact gambit. Instead of fining Monsanto for failing to keep their genes to their own fields, which is what should be done.

Law is generally the very best money can buy.
