[FamilyProtection] Why Distort The Legal HourGlass?

'The Legal Hourglass And The Sands Of Time' showed that parents involved in juvenile dependency cases have rights anchored on the Due Process Law and Speedy Hearing. With the acknowledgement of these fundamental court proceeding time frames, they would be able to avoid being tossed to and fro by caseworkers who try to act in ways to outsmart parents and use varying times as an advantage. CPS workers traditionally distorts the legal hourglass for many reasons, they are capable of doing this because their confidence to a great level is fueled by Us. If your case is being delayed or abnormally hastened, something is definitely being deviously smoked beneath it all(jeeze, is there anything that is un-devious with these people?). Why Distort the legal hourglass?

CPS Has A Weak Case

What Behind The Scene Seems Like:
Caseworker: Hello Sir Supervisor, we just removed a young child but I fear we would lose the case

Supervisor: Stall them a bit longer and go back to gather evidence that we can at least use. I don't care how you make that possible.

Caseworker: So, I shouldn't file the petition yet?, we have only two days to file it Sir.

Supervisor : Come on, you know the drill!. Go do your job and stall them till you get something solid we can anchor our neglect case on!.

A typical strategy CPS employs when they have a weak or "not so ideal" case is to delay going to the court. When people tell me of a delay, the first thing that comes to my mind is a 'weak case'. When CPS think they would lose a battle, they initiate other alternatives and route their effort to other means of acquiring their so-called evidence. This delay is not only rampant during the shelter hearing, it is sometimes very rampant before the jurisdictional stage when CPS is was unable to get temporary custody at the shelter hearing, or barely escaped with custody.

Desperation Is A Formidable Weapon

One of the salient characteristic of a caseworker is to manipulate the emotions of those they deal with, like a predator, they device ways to lure preys into corners where they can easily pounce on them. Regretfully, parents fall victim of this most of the time, and desperation is the mother of "faulty decision".

I had no contact with my child for 6 days, I was frustrated and ready to do anything to have my boy back, the social worker advised that if I cooperated I will get him back soon. I cooperated, it was sorrows afterwards (A Mother's Tale)

Delaying court hearings, keep the parents desperate and emotionally compromised, these desperation leads to many compromise on parent's end at the expense of sound judgement. Who wins then? CPS!

Who Cares If You Are Unprepared

Some abnormally fast court hearing race a lot of eyebrows for good reasons. When CPS got a solid skewed case on you, they tend to act as fast as possible so as to get total custody as possible and send the child off to foster land. Oarents are often taken unawares, unprepared and helpless. Most are unable to get a legal representative and bugged up with a court appointed lawyer. No time to prepare?, then they parents can't effectively fight back or defend themselves.

Court?

If there was a way to kick out "Courts" from the Child Protection equation, CPS would have done it along time ago. Fundamentally, court processes makes their effort of having their way somewhat difficult. This contributed to the infectious nature of corruption in family courts today. If they couldn't kick out the Court variable from the equation, why not own and run it from the shadows?!. This is why most judges, lawyers and others are corrupt and only concentrate on ways to make more money irrespective of the child that needs protection. The court personnel's economy is tied to the success rate of the CPS in every state. Go figure!.

Distorting the hourglass makes sure alternatives are tried first to get the children with ease without the tedious court processes. This helps them try ways to lure parents into bargaining off their fundamental parental rights for a List of Service or Conditions for Reunification. They assure parents to Plead guilty and they will assist them every way they can so their kids can come home early. That my friend, is a old trick!. CPS gets what they want, over-burden parents with services to get more funds off them, have access to more taxpayers dollars, and afterwards leave them on a slope of probability. Lastly, the court runs some pseudo-legal hearings for paperwork of commodity and documents of child legal kidnaps. (I am sorry for being so blunt).

There you have it, whenever you see caseworkers distorting the hourglass, beware, for nothing good or helpful is being concocted. Be smart, know your Left and your Right and every other thing in-between.
