So this is kind of interesting. The Congress might pass a bill that would require their consent to withdraw from NATO.

When it comes to treaties, the Consitution says this in Article II, Section 2:

2: He shall have Power, by and with the Advice and Consent of the Senate, to make Treaties, provided two thirds of the Senators present concur; and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law: but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments.

So the Senate is required to advise and consent to making treaties, but it doesn't say anything about breaking them.

And history would be against Congress in this case. Just a few months ago, Trump withdrew from the INF treaty with Russia. Some Reps and Senators pitched a fit, but they didn't do anything to stop it.

Looks like more showboating to me.

Sort:

That is interesting....seems like a big miss loophole in law. That could get fun if a president goes off the rails lol.

There will be wailing and gnashing of teeth for sure.
