No Such Thing as a Child Prostitute?

Holly Mitchell of the California State Senate has authored Senate Bill 1322*, which listed it's intended purpose as keeping children out of the juvenile justice system. However the bill instead creates a loophole, assuming it was a loophole, that prevents underage prostitutes from being arrested.

The law creates a situation where, "immunity from arrest means law enforcement can't interfere with minors engaging in prostitution -- which translates into bigger and better cash flow for the pimps", according to the Washington Examiner.

Nancy O'Malley, Alameda County District Attorney and a national leader on human trafficking issues, had this to say ...

"It just opens up the door for traffickers to use these kids to commit crimes and exploit them even worse."

But not to worry, "there is no such thing as a child prostitute", according to Mitchell and others.

Her reasoning and catch phrase appears to have originated back in July of 2016 during the Oakland police department scandal where several officers were raping an underage girl repeatedly while the media referred to her as a "child prostitute" and called it a "sex scandal", instead of what it was ... rape of an underage girl.

While the bill appears to have been created with good intentions, the unintended consequences from such a law once again show how haphazardly laws are created these days by elected officials.

I'm disappointed in everyone opposing this right now.

The alternative is to keep the status quo which only serves to alienate these kids and keep them from seeking help or an escape, because they know they would do time for stepping forward.

By no such thing as a child prostitute they mean that he or she cannot give consent by definition. These are victims of trafficking by pimps and rape by people who would choose to exploit them.

This bill allows them to escape their situation and put their pimp away for life without incurring a criminal record of their own.

It doesn't legalize prostitution, it decriminalizes it for the underage participants.

Those who choose to solicit a minor still face the full force of the law as do those who pimp them.

It was already the law that you cannot solicit a minor without looking at 20 to life. The difference is that now he or she can go straight to the police without fear of a criminal record. This is taking tools away from pimps.

You can't seriously have read this law and still oppose it, regardless of what the talking heads in the media are saying.

322 is not a coincidence, it occurs every 322 times a bill is proposed, and there have evidently been 1322 bills proposed in California this year. It has less significance than 333 or 666

Also can we please quit referring to every victim of this horrific crime as she. There are more young boys raped and trafficked than girls. It's just that boys don't make for sympathetic victims, but the damage done is equally bad.

Seriously, I do. I oppose most laws these days, despite others attempts to marginalize my opposing opinion instead of attempting to understand it. ;)

It's not about political correctness it's about factuality in the narrative. I find it disturbing that you never hear about this happening to boys, but the reality is that the incidence rate is higher for boys than for girls. Yet try to find anyone who looks at this and doesn't say "she". I get you were citing a particular instance, it's not on you, it's just a plea to the other readers.

I see that you want to argue a point I never touched upon and in doing so apparently want to somehow insinuate that I (or those who hold the opposing opinion to yours) do not care for children who are being abused; or it simply appears that way as a byproduct of your desire to hold a perceived moral authority over my opposing opinion.

So I don't know what to say, but I don't really see a point in continuing a conversation at this point. You've addressed me with "seriously" as though an opposing opinion to yours must be incorrect and followed that up by creating a "think of teh childrens" strawman in another attempt to invalidate my opinion before you even had an answer.

I don't know what to say cause sometimes when things are legalized - the less it actually becomes like drugs here and in Portugal but then ... the thought of kids being dragged into prostitution ... the world is a bit f***ed up these days really and poverty has just caused it. God help the children
