Does Special Prosecutor Robert Mueller have a political bias? (Part Three)

We concluded Part Two of this series saying:

Based on this testimony alone - I think you would have to say that Robert Mueller appears to be taking the IRS investigation seriously and on top of his game. Nor does he appear to display political bias in this testimony.

Unfortunately, that testimony was back in mid 2013 and much more has come to light since. It seems, while Robert Mueller said all the right things in that testimony, his actions may not have match his words.

Why do I say that?

In October 2015, CNN reported that the Justice Department in a letter to congress said:

We found no evidence that any IRS official acted based on political, discriminatory, corrupt, or other inappropriate motives that would support a criminal prosecution," Kadzik said. "We also found no evidence that any official involved in the handling of tax-exempt applications or IRS leadership attempted to obstruct justice. Based on the evidence developed in this investigation and the recommendation of experienced career prosecutors and supervising attorneys at the department, we are closing our investigation and will not seek any criminal charges.

And the Washington Examiner reported:

the head of the “probe,” Barbara Bosserman, is a donor to Obama campaigns and the Democratic National Committee. This is, someone who could hardly be trusted to understand what all the fuss is about.

Wouldn't you have thought that if Robert Mueller wanted to ensure an unbiased investigation, the people he assigned to the investigation would have had no political allegiances? But here he is naming an Obama and DNC donor to head up the investigation.

Forbes Magazine published a timeline of the investigation. You can read it yourself, but I just want to highlight a few items to review in the context of the Justice Dept's decision not to prosecute anybody:

Question - Should Doug Shulman have been prosecuted for lying to congress?

  • March 22, 2012. Former IRS Commissioner Doug Shulman testifies (downloads as a pdf) in front of the House Ways and Means Subcommittee on Oversight that there was "absolutely no targeting" by the IRS of conservative and/or Tea Party organizations.

  • May 10, 2013. During an American Bar Association meeting, Lerner admits that organizations were targeted because of their titles or beliefs

Should there have been an obstruction of justice charge or a lying to the congress/FBI charge over these missing emails

  • November 22, 2014. Up to 30,000 emails previously reported missing may have been found.

  • April 28, 2015. TIGTA reports that it has found thousands more of those “missing” Lerner emails which it believes have not been turned over previously.

I ask those questions because Mueller has shown no mercy to Papadopoulos or Flynn with respect to charging them for lying to the FBI. And it has been reported they are aggressively investigating Trump for obstruction of justice.

To me, it seems like a double standard here. It appears Robert Mueller is much less aggressive when investigating Democrats for crimes (even appointing other democrats to "investigate" them) then when investigating Republicans.

On the surface, it appears to me that Robert Mueller is exhibiting political bias in this case.

The government settled the class-action lawsuit in Ohio and another tea party challenge in the District of Columbia in two agreements last month, admitting to the illegal behavior. The Ohio settlement also called for the government to pay $3.5 million to the tea party groups, according to one of the plaintiffs.

So the government admits to illegal behavior, but the FBI under Robert Mueller saw no reason to bring criminal charges in a case that clearly favored Democrats.

The Washington Times went on to report:

Ms. Lerner and Holly Paz, her deputy at the IRS, filed documents in court Thursday saying tapes and transcripts of depositions they gave in a court case this year must remain sealed in perpetuity, or else they could spur an enraged public to retaliate. . . face death threats and a real risk of physical harm if her explanation of the tea party targeting scandal becomes public

It is clear that the illegal activity the government has admitted to must have been very bad if Lois Lerner and Holly Paz fear for their lives if the public ever found out the truth.

The only question is why didn't Robert Mueller's FBI bring a criminal prosecution for such bad illegal activity.

Was it because of political bias?
