Building A Greenhouse Without The Right Permit

A greenhouse is a great way for gardeners to try and extend the growing season, that enables them to be able to ignore weather conditions and instead opt to grow things in a more controlled environment. Growing in the greenhouse environment can sometimes provide much more flexibility and so it's no wonder that millions of people have turned to growing plants and produce etc in this way.

But if you aren't careful about going to get the proper permission before building your greenhouse, then you might find that yourself in somewhat of a mess.

Right now a gardener from New Brunswick, Canada, Paul Albert, is engaged in an ongoing battle with the city; fighting for the right to continue selling his produce that he grows in his greenhouse, from a roadside stand.

Albert grows corn and other vegetables on his property and for the last several years he has been selling them from a stand on the side of the road to people in the area.

A number of folks from around the community have allegedly stopped by to try his products. And he's got a petition going, looking for support from those who favor his products, that's trying to stop the city from taking legal action against him.

Albert says that he previously had applied for the appropriate permit in order to build the greenhouses that he wanted, but the city rejected his plans.


Despite the rejection however, Albert didn't let that stop him and he went on to build the greenhouses and started growing produce anyways.

The city insists that he needs to have his property rezoned before he can engage in this sort of activity. As there is an issue with both the location and the fact that he neglected to start building without the proper permission slip beforehand.

Albert has already been to court several times over the incident and he's still fighting to come to a resolution with city officials.

He alleges that they've required him to bend over backwards in trying to jump through their regulatory hoops, to satisfy their needs before he can simply grow some vegetables on his own property.


City officials allegedly are willing to work with Albert and it's expected that they will return to court at the beginning of next year to continue sorting out the issue. Albert still insists that no government official should be able to tell him what he can or cannot do with his property.

If he wants to build a greenhouse, what business should it be of anyone else? But because others have made it their business, now valuable resources have been wasted so that city officials can harass a man that just wants to grow food and feed his community.

Perhaps, if lawmakers didn't make it so difficult for Albert and others to attempt embarking on their business endeavors in the first place, then he and others like him wouldn't end up in such a predicament. No doubt he isn't the first one to have to endure this sort of costly battle over something that you'd think one should have the freedom to do with their own space.

Permits to survive and live? what a joke!

Get permission to use my own property and voluntarily exchange my labors with other who want my product?

laws, permits, documents etc etc.. it's getting worse and not only in my country I guess... there will be a time you have to ask approval to go to the toilet in your own house... so they can send a sewer bill!!!

Oh, I thought that only our authorities do not allow small businesses to develop. But no, everywhere there is such a problem.

I recently bought and have ownership in a farm in Virginia for our aquaponics company and we are right now having the same issues as he has. The state is making it extremely difficult and long just to have our own growing facility.

Well, at least that news article didn't seem overly biased.

If that had happened here in the states the article would very likely have framed him as some kind of mad man, possibly even the local leader of some kind of gardening cult.

Of course, cities and towns do this kind of stuff all the time. I knew an elderly couple that worked long and hard to make themselves a lean to on the back of their house so they could move their firewood closer to their house (it was in their garage that was about a hundred feet away from the back of their house)... and were forced to tear it down because they failed to get a permit.

That seems ridiculous. I have plans to turn a carport into a greenhouse. I wonder if I need a permit?
