How to investigate a murder without government

If someone hired a detective in a stateless society to investigate someone for murdering someone in their house and the detective went to this person's house and asked them if he could search the house, what would happen if they said no?

Great question! I can only predict so much based on what I know of what the market will demand and what technology will provide at that point, but I can present one possibility based on my best guesses. If the person refused to have their property searched, then that right would be respected. However, if there was sufficient evidence as might be something like today's standards of a warrant, such a declaration would be issued and they would be given another chance to allow the home to be searched. If they refused again, they might be dropped from insurance coverage or security/dispute resolution services. If there was sufficient evidence and demand, the person might become an outlaw, in the sense that they are not afforded community protection of a common law court or be banished so severely that they would effectively not be allowed to leave their own property. Of course, a few of the coming leaps in technology could completely change what is possible for accountability. Clearly, as humanity continues to evolve to be less violent, this might be so much of a freak anomoly occurrence that it's almost irrelevant. It seems like technology is on track to render much of the incentives for murder irrelevant as we become exponentially more productive, intelligent, and capable of effective communication. What do you think would happen?

The Hatfields and McCoys Fued is a good example of what would happen in the event of a Murder in a Stateless Society. No investigation. Simple retribution.
desire makes the world go round - so if the desire was strong enough in the community to create justice and to protect people, then the chances are that the community would force the house to be searched. murder is inherently in opposition to voluntary interaction and thus in the mind of many it would promote a willingness to join that sentiment of anti-voluntary action to attempt to find balance.
however, a much better alternative exists, which is the only real solution for such problems - which is the healing, balancing and evolving that is needed in general on earth and which yield enlightenment and compassion. in such an enlightened state, a being would not murder anyone and if someone is encountered who has murdered someone, it is possible for the higher consciousness to engage the murdering consciousness in such a way that they will be triggered into evolution and balance.
the problem with this is that it requires really the majority of people to have reached a level of genuinely beneficial and compassionate enlightenment before the enlightened option will be more likely to manifest than the 'kick the doors down' option.
I would engage the murdering consciousness with a high speed projectile through the head. Then that murdering consciousness can go somewhere else to exist.
that would only be temporary, since reincarnation exists. the pathways that led the killer to be present on earth would still exist and it would return. ironically, those same pathways are the ones which allowed you, as the killer, to exist. you would only be killing part of yourself.

You mentioned it already, but there would be common law courts with powers. They just wouldn't have a monopoly. Friends and family of the victim would almost certainly seek justice.
Sure, refuse to cooperate with the court. Then lose protection within it. Now good luck when you are victimized.
As a PI too I agree that the entire process can and should be privatized.
The accused's security provider could also agree to monitor such a search. Or on being dropped as in your scenario, he would be afforded no protection should a forcible search be carried out.
I love the quest/discussion to find peaceful peaceful responses to even murder. Great points have been made already! I just want add, I think in order for humanity to be ready to handle that type of offense in a healthy/life-promoting way we must learn and practice these principles in even the most mundane of offenses. Things from being cut off on the highway to someone going off on you for a difference of opinion. I think it is (in some ways) easier to come up with extreme ideas then it is to be introspective enough to discover our own person weak spots in our peaceful communication.
