A thought on licenses.

in #law8 years ago

Have you ever went to go get a fishing license or a marriage license or how bout a drivers license. I bet most of you do. Most of you did or do. You most likely still have those licenses. You need a license to get to work every day. A fishing license to sustain yourself. A marriage license to show as a token of love for another. Or how about a gun license to defend yourself against intruders. All of these licenses are obtained from government in forms of different ministries that administrates those licenses and its fees.

Its important to know that you have to PAY those fees in order to obtain a license to do whatever it is that you want to do. You have to pay to obtain permission to do something.

When you deal with GOVERNMENT anything and everything is always LEGAL. And thus the LEGAL definitions apply. And those are governed by an ACT. But have you ever wondered what exactly a LICENSE means by definition in LAW?

http://www.duhaime.org/LegalDictionary/L/License.aspx

" A special permission to do something on, or with, somebody else’s property which, were it not for the license, could be legally prevented or give rise to legal action in tort or trespass."

Meaning a LICENSE is PERMISSION to do something that would otherwise be ILLEGAL.

Wait, what? Yea that's right. Read that again. You need a LICENSE to do something that is ILLEGAL. Having said LICENSE gives you permission to break the LAW.

For example. If you have a gun LICENSE. You can carry a gun even though its against the LAW. If you have a driving LICENSE, you have permission the break the law as much as you want. If you have a fishing license you can fish even though its against the LAW. This applies to essentially all forms of licenses. So in short a license lets you break the law.

So now you have to ask yourself who made it a LAW to forbid such a thing. THE GOVERNMENT. The GOVERNMENT has passed laws that prevents you from doing a certain ACT. In fact its safe to bet that ALL LAWS ARE PROHIBITIVE in nature.

Obvious examples are that you cannot possess marijuana without a license. You cant have a gun without a license, you cant fish without a license. All because of LAWS saying you can't.

Lets recap. A LICENSE is needed to break the LAW. a LAW that GOVERNMENT made. The same GOVERNMENT then sells you that right by way of a LICENSE for a price.

GOVERNMENT enriches itself by making laws and selling rights to break them.

It is in the GOVERNMENTS INTEREST to make more LAWS to PROHIBIT and REGULATE those RIGHTS.

Sort:

Yea A fishing license
I think some places require that for You to
go camping
Then get worms,
I've even hunted for nightcrawlers
and had a few successes
After a good rain

Indeed. But i believe you missed the point of the article.

I was trying to make clear that government didnt have the right to sell you rights you already have and call it a LICENSE.

Also:

All laws are prohibitive. Supposedly to protect you from harm. So, how is it that someone can buy a license to do you harm?

One of the points i was trying to make.

You need a license from the city to replace a broken window in your own house, to hear them tell it.

Ridiculous right?

And I have not looked into it but I'd bet a small sum that there's a fine for not fixing a broken window. Safety first.

So i looked it up and confirmed with a friend who is a home builder.

You need a permit if you are swapping out the frame or making any alterations regarding the structure of the house.

You do not need a permit if you are only popping out the window pieces.

This is fairly universal.
