Facebook's parent Meta Platforms has said it is concerned about India's forthcoming privacy law which requires local retention and data processing, the company's submission to the Securities and Exchange Commission (SEC) has been revealed.
"Some countries, such as India, are considering or passing legislation using data protection requirements or requiring location and data processing or similar requirements that may increase the cost and difficulty of delivering our services," the company said.
It adds that new rules or regulatory decisions that limit its ability to collect and use information about children may also limit its advertising services or its ability to provide products and services to children in certain areas.
The Parliamentary Joint Committee reading the Data Protection Bill, 2019 submitted its report in December. The report and the draft law submitted by the committee recommended that sensitive personal data continue to be kept in India under Section 33 of the Bill and that its transfer will be allowed outside India only under certain conditions under Section 34.
The EU General Data Protection Regulation (GDPR) imposes similar conditions on data transfer to only those countries that meet ‘data adequacy’ standards, Indian officials argued.
They also say the retention of sensitive personal data within India will support the growth of hyper-scale institutions and a new data-driven economy.
Meta also said it was in control of investigations and cases in Europe, India, and other departments. It spoke directly to the case pending before the Supreme Court of India as well as government questions and cases related to the 2021 review of WhatsApp terms of service and privacy policy. Whatsapp has also challenged the Central Government Act of India which authorizes messaging tracking and will require a Meta-based instant messaging application to violate its final encryption.
