The family from Koryazhma is trying to return the daughter, who was taken by the Italian CPS. Trap, in that parents being boxed themselves themselves

Hello everyone! We have read a lot of posts about illegal actions by the CPS. But sometimes parents themselves drive themselves into a trap and untie the hands of the guardianship authorities. This case was widely publicized in the media. 43-year-old Svetlana Davare took little Anya to the North of Italy in August 2015. In Italy husband-an Italian was waiting for a woman. In Russia. In the city of Koryazhma, Arkhangelsk region, stayed father of seven-year-old Ani -Sergei Sidorov, with whom the girl's mother divorced in 2013. According to the 57-year-old man, Svetlana took the girl out of the country illegally, without his consent.

In the spring of 2017, after a nervous breakdown, Svetlana went to a specialized clinic. At the time of treatment of the mother - Anya was placed in a family home.

After learning about the incident, in November 2017, Sergei filed a lawsuit in the court of the city of Koryazhma, demanding to determine, that the girl should live with him. At the same time, the Milan Consulate General of the Russian Federation told the father, that the only chance to return the child to Russia is to achieve a corresponding decision in the Italian court.

Now a little more. Svetlana and Sergey got married in 2009, and a year later they had a daughter Anna. But family life did not work out. Svetlana, according to her ex-husband, had a dream: to change her place of residence. But Sergey refused.
Soon Svetlana met online with a citizen of Italy, Federico Davare. In 2013, she filed for divorce. By the time the couple had already lived separately. Sergei was afraid, that his wife would sooner or later take his daughter abroad and asked the court to impose a migration ban. The court granted this request.

The positive decision was later revised. Svetlana was allowed to take Anya abroad for rest and treatment. In may 2014, the Russian woman registered a marriage with an Italian and several times went to visit him to begin to equip a new life in a small town — the ski resort of San Cassiano in the province of Bolzano in Northern Italy. In August 2015, a woman without the permission of the child's father took the girl to Italy. Sergey waited, that his daughter will return. Without having waited, the man addressed in migratory service, but received the answer, that illegally taken out the child is his family problem. All this time Svetlana did not get in touch with her ex-husband. The first time Sergey was able to communicate with his daughter by phone only in January 2018. At that time, she had been living without her mother in the family home for more than six months.

"I did not know, where they were, did not know the phone number," says Sergey. Attempts to find out about the whereabouts of Ani from relatives of his ex-wife also did not give results. All this time the man continued to pay alimony and waited for Svetlana to return to Russia to re-impose a ban on the export of the child. Upon arrival in Italy, Svetlana and Anya legalized their stay in the Republic, having received a residence permit. The woman did not work, and her new husband worked as the seller in shop. According to Sergei, the relationship of the 5-year-old girl with the stepfather went wrong. She was afraid to move to another country from the very beginning. Ani's mother herself admits, that her daughter was always capricious and jealous of her stepfather.

Because of these problems, Davare asked a local social worker Johanna Clara to help find a psychologist for the girl. From Svetlana on the background of the change of residence also started psychological crisis — no job, no friends in a new place the woman was not. So she turned to a psychologist, too. He diagnosed "obsessive-compulsive disorder" and recommended a three-week treatment in a hospital. "The psychologist offered me therapy on phobias: if I feel, that does not pass, it will be possible to stay longer, — Svetlana tells. - My husband said no pills. When I went to the hospital, I had to leave a baby somewhere. My husband's mother did not perceive me, constantly scolded me. From all this I had fears, that I am not accepted here." A negative attitude on the part of the new family was not allowed to leave Anya under their supervision. And her husband Federico always disappeared at work. Social worker Johanna Clara advised the woman to give the child to the family home for three weeks of treatment.

After leaving the clinic, the Russian woman tried to pick up the girl, but was refused. Local care questioned her recovery and required re-hospitalization. It turned out, that according to the contract signed by Svetlana, the child was placed under guardianship in the family home of the city of Rovereto in the Trentino region for an indefinite period. According to the woman, she only in words agreed with the social worker, that will leave the daughter for three weeks. In fact, when Svetlana came for her daughter, she was told, that Anya would remain under the care of another family for another two years. Svetlana was allowed to visit her daughter only twice a week. Then the number of visits was reduced to once every two weeks and only under the supervision of a specialist.

As a result, litigation began with the Italian authorities. The court sided with the guardianship, although the child's mother was not deprived of parental rights. Italian justice listened to the opinion of the guardianship and saw no evidence of a complete cure of the disease Svetlana. Without further treatment, the court refused to return the child to the mother's care. According to the decision of the Italian juvenile court of 18 April 2018, Svetlana did not raise her daughter properly. The document refers to physical violence against the child, the cries that caused the girl stuttering. According to the court, the girl during a meeting with a mother became Moody and cried, and while in the family home was quiet.
As a result, the court decided to establish custody of the minor Anna until the mother is able to understand and provide for the needs of her daughter. To this end, the mother must undergo treatment, which is a necessary condition for increasing the number of visits.

Svetlana is very worried, that her daughter can be taken away from the family home and adopted by another family. Therefore, in may 2018, together with her husband Federico, she tried to take her daughter to Russia during one of the visits. The couple put the girl in the car, after buying tickets from Vienna to Russia, and left Italy. To go just in case decided by a district way - through Bavaria.

After crossing the border with Germany, their car was stopped by German police. Svetlana was taken to the police station, where she was interrogated. The child was sent to a German orphanage. At the same time, Svetlana was contacted by a social worker and demanded to tell her where her daughter was.Svetlana told about the location of the girl in Germany. As a result, Anna is back again in someone else's family in Trentino. From the point of view of Italian justice, Svetlana violated the law, to see her daughter is prohibited. At the same time Svetlana's relatives tried to intervene in the situation, they found out, that Anya was in a strange family, only in October 2017. Svetlana's sister asked for help from the Commissioner for children's rights at the Governor of the Arkhangelsk region.

At the same time, Ani's father hired lawyers in Russia and Italy. In November 2017, he filed a lawsuit with the court demanding to determine the place of residence of Ani with him, but the decision has not yet been made. According to the statement of Sergey, the child residing with the mother is not in the interests of Anna. In addition, Svetlana systematically and for a long time to let the girls communicate with the father. Sergei blames his ex-wife for the fact that the fate of his daughter was in the hands of Italian social services, and demands to deprive the former spouse of parental rights. He refers to the Convention on the rights of the child, which refers to the inadmissibility of the separation of a child from his or her parents against their will — except when necessary in the interests of the child.

Ani's father also asked the Russian foreign Ministry for help. At the end of June 2018 from there came the answer, that the situation is under constant control of the Consulate General of the Russian Federation in Milan, but they have no right to occupy this or that side in the family conflict. This should be done by an Italian lawyer. At a meeting with a lawyer in Italy for the signing of the contract, the man arrived in may 2018. According to him, then he couldn't see the daughter, because meetings with the child are resolved only by the decision of the Italian court.Sergei is fighting for the return of his daughter to her homeland, where he will be able to provide her with all the conditions for a comfortable stay and education. Now he is waiting for the decision of the Russian court, and only on the fact of such a decision will be able to appeal to the Italian justice and return the girl to Russia.

I think it is necessary to remind, that it is very important not to transfer the child to CPS and not to sign any documents. If you have given voluntary consent to the placement of a child, for example, in a family home or a foster family, it will be difficult to return it back. Svetlana partly itself drove the daughter into a trap, after all her father is now powerless from the point of view of the legislation. We may have different relationships with our ex-husbands and wives, but we have to remember, that when a child falls into the hands of the CPS, only the native parents can bring him back and are interested in it.

A really crazy story indeed. I blame the mother Svetlana for being selfish. She probably could have prevented all these if Sergey was fully involved with his daughter. Crazy...let us hope the girl does not pay for their sins more than she already has.
