UNCROC: reflection of CPS practices in Canada, UK, Australia

Welcome back steemers

Today we are going to engage in another look at :

  1. Differenciating between legal definitions
  2. Children's Rights
  3. Evidence rules

I wanted to quickly add, I thought about if I should or should not continue writing about Canada laws. It weighed on me as if it was an elephant on my chest. Reason behind it is, I'm not a citizen. My battle is here in the states, was one thought. Yet the conflicting side was, families need help... so Idk. I'll continue to weigh this out silently.

Legal Definitions

All of Canada's laws are straight forward. Very easy to understand, and laid out quite well. Today, we will be looking at two aspects pertaining to CPS removing children from homes.

Lets start off by looking at the word kidnap:

For sake of arguement we will assume the above definition satisfies the legal definition. So you see how kidnap is defined, illegally by force? That's the kicker. Each CPS employee is legally defined as a guardian. A guardian in Canada has lawful authority to be responsible for a child. remember this

Let's look at the word hostage:

Here you see no mention of legal or illegal, no scope of authority. Here you see that it's defined as held as a security for fulfillment... that's what this is. CPS is taking hostages as a means to fulfill their internal quota / obligations. Start calling it what it is. Teach this to your children.

Childrens Rights

Upon researching more about CPS and lawfulness of their practices, I found this really cool poster. This poster is from the UNCRoC. So Im including it in this post because if children can stand up and say, "I want to go home to my family. I was happy until CPS person took me hostage." CPS will cave quickly.

And since Canada, Australia, UK and other nations all recognize UN treaties this would be very beneficial to teach your children.

Below lets look at different articles and ask yourself, did they infringe on my childs right?

Article 4
Article 5 >>take note, burden is on parents
Article 9 >> does foster family treat child well?
Article 12 >> adults (judges) will listen if a child says they're taken hostage
Article 16 >> by destroying the home, what did this act do to child in regards to privacy
Article 19
Article 25
Article 35 >> oh boy NO ONE - pay attention
Article 36 >> if children knew CPS person gets bonus for cases
Article 37

Looking at these, now matter how dilluted the wording is nor contradictory it still makes the case the child's rights have been violated by being forceably removed from the home.

Rules of Evidence

In Canada DO NOT form an affidavit unless your sworn to do so. The safest way for a family to gather evidence is get ahold of what CPS is alleging, how they obtained that information. The other safe way is to have your children fight as well. Its sad, but think its best route. A child can use any medium, there are no limitations. They could sign and date a drawing or poem of how they feel. Courts will give consideration on this alone.

Other way for families seperated is to video document. However you decide to video document, you should have a clean USB stick. The only contents on this stick should be video logs of the child in format of name_date. Reason is so that way Judges can determine this is an original, made on this date..etc etc. It can be verified as genuine.


Basically as you continue to fight you should remember:

The guardian is legally responsible for child as long as theyre not in your care. If child is mistreated this becomes a criminal case. If as you continue to gather evidence, you can determine caseworker committed an indictable criminal act it only helps your family.

Be mindful that CPS is not a civil nor criminal matter. Oddly enough. Parents already have rights guaranteed to them through various UN treaties. So if you can prove without doubt CPS did something wrong file a federal case. Submit everything to the judge and let them decide.

You don't have to be a citizen to care, or speak the truth, I don't even havery kids yet for instance. Great work. I agree that parents need to find a way to get their kids involved as a way to fight. I think someone mentioned the need to educate our kids on the dangers of CPS in a previous article, it's certainly an effective strategy... I think

the truth is that there are many rights but these are often omitted by the legal representatives of the vulnerable, they even seem to disappear
