Hehehe, good question...
No, they are not free, with free elephants you cannot play like this.
It's a so called elephant camp, they offer jungle tours and posing with tourists.
There are some good camps and some are not so good, I didn't see the bad ones until now...

Maybe it's better for them to live in a camp than die in fact of poaching... But I don't like it nevertheless to see animals in a prison...

In the National Parks live free elephants, they get very good controlled, for poaching are very high penalties in Thailand, not sure death penalty, too

This elephant doesn't look unhappy just to throw in my 2cents worth here

Thanks @chelsea88, to be honest, I never saw a sad elephant until now, I think they like to work with people

Yeah i think it's possible to live in complete synergy with these gentle giants

I don't know you know the movie Onk Bak, there are so unbelievables elephants scences, there you can imagine more about complete synergy:
