Documentary Review Making a Murderer P1 E4 Indefensible

in #story5 years ago

Judge Fox finds Brendan Dassey's "confession" is admissible. His lawyer Len Kachinsky doesn't seem too concerned and greets the press with smiles. You get the sense here nothing is going to go the defendants' way. The first words we hear from Kachinsky is how he just came in third place for some office he campaigned for. It's obvious that's the first thing on his mind. Let me be blunt. Brendan is an idiot in the psychological meaning of the term. I believe the army calls it 4F in their recruiting tests, idiot. We then see Kachinsky's investigator give a form to Brendan asking him to choose between "I'm sorry" or "I'm not sorry" for "what I have done", like the old when did you stop beating your wife question. They then turn over this new confession to Fassbender and Wiegert so they can interrogate Brendan again for another three and a half hours, without Kachinsky present! They reuse the line about already knowing what happened but just need to hear it from Brendan. It's hard to determine whose side Kachinsky is on here. Is this how our justice system really works?

Then, get this, judge Fox denies Brendan's request for a new lawyer after Brendan tells the judge he thinks Kachinsky thinks he's guilty! Kachinsky claimed to the judge that this request is really coming from Steven and walks away from this ordeal with that smile on his face! Brendan then hand writes a letter to the judge recanting his "confession" which Kachinsky reads in front of the camera laughing, then says something about Steven as if it were relevant. When judge Fox learns Kachinsky allowed Brendan to be interrogated alone he finally pulls Kachinsky's card.

Records

They find Steven's wife had call him twice from prison the afternoon the crime occurred. They have two lovey poo conversations one lasting 15 minutes. There was no sense that Steven was rushed or otherwise busy with something else. No noises in the background.

Key

The key had no DNA from the victim, only Steven. This obviously means it was scrubbed clean before Steven's DNA was put on it.

rav4

The Avery salvage yard had a car crusher on the property. Steven was using it the day before the rav4 was found. Steven's fingerprints are not on the rav4. The blood, which would not have gone through rubber gloves, was found only in certain spots in the vehicle.

Blood

After reviewing the clerks file on Steven Avery, Buting wants to look at a vial of blood from evidence. This vial, which was transferred by sheriff Lenk, was found to have a needle hole in the top. This sample was not to be tampered with and the attending lab vouched it was not they who had punctured it.
