Buying property in Bulgaria. Documents

In the first part, I wrote where to start the choice, in the second part, what kind of property is in Bulgaria. Now go to the purchase.

There comes the third stage - the most painful, because here it is already necessary to decide: to take or not, and how? That is, from whom or with whose help. In general, one way or another, you will have to work closely with vendors, if before this was successfully avoided.

If during the selection process you smoothly joined the Bulgarian real estate system, met with the sellers and developers and found your ideal option, then this item can be crossed out. You can simply buy this apartment from the developer. It goes without saying, having first read all the permits.

What documents must the developer have:

  • Certificate of current status issued by the "agency for inscribing".
  •  Permission "for scheduling".
  •  Act 16: commissioning permission.
  •  If the object is not completed, then it must have either Act No. 14 (rough construction stage) or Act No. 15 (the building is fully completed, but not yet put into operation).

If you buy a secondary property from the owner, roughly speaking, then you need his Notary Act. This is a document proving that the seller owns what sells.

you buy through an agency, then the realtor must provide you with all the above documents of the developer, plus a Certificate of the current status of the agency. Certificate of the current status of the company. This document has a statute of limitations, do not forget about it. Always look at the issue date and status.

All these documents are necessary only for you - in order to be sure that you work with real-life companies.

The only document that the consulate may require from you when applying for the owner’s visa in addition to your notarial deed is ACT 16.

In order to find out whether there are any encumbrances from your future property, whether it is pledged or mortgage, you must order an extract from the “Imootny Register”.

This document is received on the day of signing the notarial deed. But there is one nuance: this document provides information, at least two weeks ago, that is, as if lagging behind. After all, this certificate is ordered in advance and wait more than one day. If you have concerns that during these two weeks someone had the opportunity to do something with your future property, help is better to re-order and wait another two weeks.

Documents for the transaction

  • What documents are necessary for the buyer for the transaction:
  • passport or personal card (if you have a residence permit),
  • Declaration that the spouse (spouse) is not against the upcoming purchase.

The last document is needed only if one of the spouses is entered in the notarial deed. However, you can do without a declaration if you want to keep your purchase secret.

All documents from your side, except for the passport, must be drawn up in Bulgarian and notarized. This is usually done at the Bulgarian consulate in Russia or already on the territory of Bulgaria in the presence of an interpreter.

The documents of the developer and the agency, in any case, will be in Bulgarian with signatures and seals. Therefore, in order to understand them you need a translator and a legally savvy person. These may be copies and faxes, not necessarily certified.

There are two more documents: a preliminary contract and a notarial deed for the buyer, but about them later.

Next time I will try to describe the difference in the work of the developer and the agency in order to be able to determine through whom it is easier for you to make the choice and purchase of Bulgarian real estate.
