Trying to enforce tort law while explaining blockchains, DLT, Steem, ninjamining, etc, would be very costly. Has damage already been done?
Essentially the status quo continues (stake is only used for delegating) and it will be negotiated in the meantime.
I don't think negotiations will go well if those negotiating accuse eachother of serious crimes and start threatening lawsuits.
Some could argue unequal or bad faith negotiations and turn their back on any agreement, but that would also be seen as a serious escalation.

You're not wrong. Lawfare is going to be the last resort of anyone in this matter. I'm sure both sides of the negotiating table are well aware it's an opportunity of great import, if they can prevent ill humor.

Yeah what worries me are some of the gungho witnesses really want a voice at this townhall or whatever. I hope coolheads prevail and pitchforks are left at home.

Sitting quietly in a corner never gained anyone an empire. Personally, I don't have any interest in an empire. Quiet corners suit me fine.
