Random Social Media post can be Criminal
My RANT for the day on
criminal charges related to
SOCIAL MEDIA POSTINGS.
(Im not in trouble haters just food for thought)
When people are getting criminal charges for posting on FaceBook but committing no physical Crimes or physical criminal offense.
Ummmmmm.......Yeah.......
REMINDER
Its just words.
I mean anyone can say they are a king Pin drug dealer or a serial killer. Even typing out a story in comments.
It doesn't mean its true.
It could be a 85 year old man/woman hospitalized claiming to be a 27 year old.
It could be a 15 year old teenage girl from Brooklyn New York living in the projects. Who's acting as if shes a 35 year old business owner from San Francisco California.
If I was an attorney.... I would fight to get any social media criminal posting charges thrown out!!!!
The system can NOT just criminally charge someone on pure speculation.
They need to have evidence.
A internet posting isn't physical evidence. You cant touch it.
Its only a collection of typed words in a digital world.
How can they even prove a person typed it.
If Equifax can get hacked & over 146 million people's information get compromised.
Then its only logical to think that Facebook postings & anything digital isn't physical proof. Its just a sequence of code & numbers, which in return appears as words through a technological system. ITS NOT EVEN THE PERSONS PHYSICAL HANDWRITING.
Who's to say the computer didn't accidentally post something that another person posted but a interference happens causing it to appear on someone else's profile.
I know numbers of people who have had there photos pirated, names & fake profiles created which make attempts to scam people out of cash.
This doesn't mean that identy is now a criminal scam artist. Technically They NEED to have physical evidence to prove a persons motive & To prove the person is behind the screen.
Even if the IP address is connected to the individuals personal system. It still doesn't show that person actually typing the post.
Thats what my argument would be if i was criminally defending someone in court for posting things of Facebook.
There should be no CRIME if there is NO VICTIM.
There should be NO crime unless its acted out!
Just simply saying something or typing something doesn't mean you are a criminal!
I could run around the internet posting every where that im a fucking Alien from outer space here to take over the world through War!
That doesn't mean the system can then go an criminally charge me w/ being a terrorist.

Depending on the context of the conversation this quote could be used in a positive situation or negative situation.
Its a figure of speech used for DECADES now. Im sure everyone has said this in their life.... at least once.
It doesn't mean everyone is a terrorist, or potential murders.
There are logical ways of dealing with repetitive harassment on the internet where harm is being typed about.
EXAMPLE:
#1 BLOCK THE PERSON
#2 save the harassment postings dedicated to you.
#3 get a protective order.
#4 if the person acts out the typings (its now a CRIME!)
Now the posting has physical information to back up the claims.
#5 if the person violates the protection order.
#6 call the police..
My point of explanation is to show that as a HUMAN BEING with a working Brain... we know whats right & wrong.
John Doe posting about how hes pissed off at a Kroger Grocery store employee for Pulling out in front of him in which John Doe post "im gonna run him over next time!"
That doesn't mean he is actually going to commit this act!
HAVE WE FORGOTTEN WHAT CONTEXT WAS?
Think Logically
Freedom of speech still exist
Any law placed after constitutional law os VOID according to the constitution.
LAWYERS, JUDGES, COPS, agents, etc....
system workers in general,
You NEED to remember what you were Oathing to.....
It was constitutional law as it was written.
NOT ADMIRALTY LAW, that system had no jurisdiction here.
Stop trying to CENSORSHIP the human experience.... our existence is FAR more meaningful & far more complex than BULLSHIT voided laws that are attempting to shelter a free being in this universe.
