The Outer Space Treaty & Moon Treaty.

The Outer Space Treaty considers Outer Space to be the “common heritage of mankind”. It belongs to all of us.

The Moon and other celestial bodies are to be used for peaceful purposes, there is to be no installation of weapons of mass destruction on the Moon, celestial bodies or anywhere else in outer space. “Establishment of military bases, installations and fortifications, weapons testing and military maneuvers on celestial bodies” are forbidden. The Moon may be used for scientific research or any other peaceful purpose for the benefit of all countries without claim to it's sovereignty.

Although the Outer Space Treaty states that outer space isn't subject to national appropriation, it doesn't mention whether or not a private individual or company may own parts of outer space. The UN’s error in not realizing the Moon Treaty excluded corporations and individuals is still in attempts of rectification today.

As of July 2014, documents relevant to the following United Nations Treaties and Principles on Outer Space are available online:

  • Treaty on Principles Governing the Activities of States in the Exploration and Use of Outer Space, Including the Moon and Other Celestial Bodies; *to my understanding this includes The Moon Treaty and Outer Space Treaty.
  • Agreement on the Rescue of Astronauts, the Return of Astronauts, and the Return of Objects Launched into Outer Space;
  • Convention on International Liability for Damage Caused by Space Objects;
  • Convention on Registration of Objects Launched into Outer Space; and
  • Declaration of Legal Principles Governing the Activities of States in the Exploration and Use of Outer Space

Only 11 states have signed it but 129 nations have signed the 1967 Outer Space Treaty.

The Moon Treaty is not law today because only 6 (of 185) states of the UN supported it. Space-faring nations like Russia, China, UK, USA etc. refused because it did not allow for exploitation of the universe by corporations and individuals.

No celestial body is owned or claimed by NASA.

There are currently no existing laws on the Moon or planets. If we are to live on the Moon in future, laws regarding extraterrestrial claims need to be established. An example by Moon Estates: The argument that only individuals financially able to go to the Moon, may do so.

The Lunar Embassy (although not a governing body) disagrees as this allows financially fluid corporations and organizations ownership of extraterrestrial property because they can afford it and the regular person would lose their claim.

Conditions on the Lunar Surface aren’t ideal to Life.
Mars may be a far better idea (although Lunar enthusiasts argue the Moon is closer to Earth, making a more practical option).

What is Lunar Regolith?

Regolith is sharp, jagged particles of lunar dust.

“During the Apollo landings, the astronauts often found it necessary to use a hammer to drive a core sampling tool into it. Once astronauts reached the surface, they reported that the fine moon dust stuck to their spacesuits and then dusted the inside of the lunar lander. The astronauts also claimed that it got into their eyes, making them red; and worse, even got into their lungs, giving them coughs. Lunar dust is very abrasive, and has been noted for its ability to wear down spacesuits and electronics. The reason for this is because lunar regolith is sharp and jagged. This is due to the fact that the Moon has no atmosphere or flowing water on it, and hence no natural weathering process. When the micro-meteoroids slammed into the surface and created all the particles, there was no process for wearing down its sharp edges.” source:Universe Today

Pairs of astronauts could only live on the surface, in the tiny Lunar Module for 3 days at a time.

What are your thoughts?

I would prefer Mars vs the Moon. Regoliths are a no-no and the lack of H20 is a deal breaker. There's no hiding from regoliths, considering surface temperature's go from scorching to freezing. I did however, find the whole subject interesting. Makes you think!

Selling real estate on the moon is total bs, only topped by buying it. To sell something you would have to own it first. I could might as well sell plots of land in the Central Park.

Yeah, as I said... At the end of the day its irrelevant what some smart ass lawyers say. You own a piece of land if you stand on it and are able to kick everybody's butt who wants to take it from you.
Looking at it the traditional way, the only one who could claim any property rights are the USA on the moon, because they had actually "representatives" there who planted their flag.
Else, of course everybody can claim to own a planet - there are more than enough out there. :)

SF fan! What's the book? i'll give it a peek. Yes, I agree with you! at this point i'm just curious as to why anyone would want to live or own land on the moon? it's inhabitable and sounds awful other than great views. Then I think, the same Space laws apply to Mars right? Elon Musk has plans to colonize Mars and land Red Dragon in 2020 with China and the UAE following suit.

i fell down the rabbit hole, lol now I have all these questions! forget the moon, what about Martian land? why such interest and development in moving to Mars? It'll probably cost millions of dollars per person one way, majority of us wouldnt be able to afford that, but why would anyone live/move if you can't lay claim to Martian land? it's the same story as with the Moon. if the US, China and the UAE all lay claim to Mars, when the Outer Space Treaty states no nation may lay claim, what happens? lol i should call it a day and ponder this tomorrow!

That book was from a german writer, I dont think its available in english. I can give a quick wrap up: its about a guy, who reaches adulthood in a highly developed alien civilisation. Its custom there, that everybody gets a planet as a present on that occassion. He gets Earth. Its also custom, that they have to go to their planet and look around and learn about it. Its extremely rare to find intelligent life somewhere. For them such a journey is like going on a little holiday trip for us, so they just drop him off from a mothership outside our solar system, in a small one man craft. Since he is not the best pilot, he manages to chrash land the thing in a small german village.
After that, its more about how he experiences the people and their life here on Earth...

As to whats to be found on the Moon or Mars - I dont know. But they are entire planets, so there must be something. If nothing else, at least you will have your peace there, no noisy cars, pesky Jehovah's witnesses ringing on your door, or stuff like that.
Once people go to Mars and settle there it will be hard to deny them rhe right to stay. The UN may condemn that all they want - what can they do about it?

that sounds really interesting and almost a reversal of the Time Traveller's (an Earth human) experiences with Weena on planet Eloi (H.G Wells', The Time Machine) - wish i read German!

Prettier places here on Earth with no cars etc (how much longer though) :p oh you can bet they'll find something to do about it/profit somehow. Although I doubt other spacefaring countries would let it slide, they'd all want a hand in making the pie. We can only wait and see lol
