Let's Embrance The Law

Today more than ever, the deep, lasting and effective fight against corruption is one of the priorities of many countries and is undoubtedly a global challenge. An effective rule of law reduces corruption and protects people from injustices, large or small. It is also the foundation for prosperous and peaceful communities with equal opportunities for all. It is the foundation of development, of an accountable government and of respect for fundamental rights.

To speak of a crisis in one's thoughts is always to speak of politics and society. Since the beginning of the century we have seen how many democratically elected rulers have imposed themselves over laws to the point of not enforcing them and modifying them in their own way. While this is not a constant that is new, I mean, non-compliance with the laws, if it is something that is happening frequently and increasingly normalization of this type of actions.

To confuse, he who cannot govern himself cannot govern his family; he who cannot govern his family cannot govern the state. If he who governs is not worthy, if he considers himself a higher entity above the laws he loses much more than he really believes he gains for himself.

Governing implies a higher responsibility than maintaining law and order; government has a vital role to play in developing virtue and promoting prosperity and happiness. Government is nothing more than an entity created to maintain order and preserve people's happiness, that is, in theory governments rule by and for people.

"As the king is, so are his subjects," says an ancient adage. People always look to the example of the ruler and the Administrator and not simply to their precepts and orders. The responsibility for bad conditions rests primarily with them. Iniquity and injustice exist only when power is replete with corruption, incompetence and abandonment, and by those who seek to take advantage of and enjoy themselves at the expense of society.

That is why the rule of law concerns not only lawyers and judges, but also all members of society, for it is they who can make the state of laws prevail, no matter who comes to power and what means they use if the rule of law is enforced - all the evils of society and the state will not go unpunished.Plato advocated a kings-philosophers government because philosophy is necessary to understand duties and relationships. It provides wisdom.

However, I would like to differ with Plato at the point where power corrupts the human being beyond his convictions and virtues, although not all are prone to corruption, most rulers lack the wisdom to have a broad view of human welfare and therefore it is simple for them to fall into malpractice. Corruption has become commonplace throughout the world, and profit and pleasure come before a sense of responsibility and concern for people. In all parts of the world those who hold power, whether because of their position or their wealth, have little to fear when they break the laws and rules that are applicable to all citizens.

If there is an enemy of the law and the rule of law is power, if by convention we all accept that there is nothing above the law we would not have the serious problems of corruption as we have had throughout history and today. There is a moral superiority in laws that takes precedence over any mandate and that no human being can violate. It is common for people with power, usually people with power, to commit criminal acts on a large scale and with impunity. This is precisely because those who exercise the laws are easily corrupted in the face of power.

This is why the beauty of the American Constitution lies precisely, a timeless contract still in use nowadays. The American founding fathers created it so that no one would be above it, and so that no one would have the capacity to modify it, let alone violate it. This document has remained in force today because all Americans by a general consensus accepted that no politician or state can be above its constitution. Unlike many states in the world that modify their constitution each time there is a change in the paradigm of their governments, this could be a key point to really understand why some states succeed over others.

A large number of rulers are above the law. This leads to rapid degeneration and contempt for ethical standards among the people of the world. When just government prevails, "unvirtuous men submit to those of greater virtue.

When the government is made up of people who lack a high sense of responsibility, the opposite is true. The council of wisdom calls for governments to abide by a strict and noble code of conduct that will bring good and peace to the inhabitants of the earth.

The law regulates the legal system of a country or society, is dictated by a legislator, which is considered the competent authority is the one who commands or prohibits something in relation to justice whose failure to comply with carries a sanction and although it applies especially to the state and its officials, is of great importance since it must be general observation, followed by all and is mandatory.

Compliance with the law makes us creditors of rights and guarantees that allow us to make a demand both to the rule of law and those who are incurring in this fault, in addition to being deprived of our freedom, depending on whether it has been stated in the code or regulation that we have accepted.
