PIP claimants may get £5,300 back after DWP Huge Mistake


The DWP made a mistake in the law when it gave points to PIP claimants for how they interact with others face to face in their PIP assessment.

About 300,000 people may be entitled to money Many people who get Personal Independence Payment (PIP) may receive refunds of up to £5,000 after the Department for Work and Pensions (DWP) changed its rules.

The change happened because of a Supreme Court decision in July 2019 that affected how the DWP does PIP assessments. PIP is a benefit for people who have long-term health problems or disabilities that affect their daily life.

PIP has two parts - the Daily Living Part and the Mobility Part - and each one has a lower and higher rate. If you qualify for both higher rates, you get £691 a month. The DWP checks how much you should get by doing a PIP assessment.

The Supreme Court’s MM Case changed what “social support” means for the Daily Living Part of the assessment. The DWP was wrong in the law when it decided how many points to give PIP claimants for the activity of “engaging with other people face to face” in their PIP assessment. This meant that some claimants got fewer points than they should have, which reduced their PIP payments.

The DWP began to review PIP claims that could be affected by the case in 2021. In its most recent update, published in October last year, it said that it had looked at 79,000 claims against the MM Case and that it planned to look at about 326,000 more.

It also said that it had paid 14,000 people who had been affected a total of £74million - this works out to an average of £5,300 per person. But remember that some payments will be more and some less, depending on each claim. The DWP has asked about 284,000 PIP claimants to get in touch with them if they think they may have been affected.

The charity Disability Rights UK said that the people who may have missed out on the Daily Living Part of PIP, or who got the lower rate and may deserve the higher rate, include:

People who meet regularly with a mental health professional, who helps them cope with face-to-face interactions People who need the help of specific friends or relatives who know how to support them in social situations, not just any friend or relative, to manage face-to-face interactions "
