I would imagine part of the reason they are not tested is that by themselves they don't prove a crime, if this woman's had been tested then they could prove that they had sex but they would still need more evidence to actually prove rape, at the end of the day these cases are hard to prosecute because even with DNA evidence how it got there is still a he said/ she said scenario without a confession or other evidence.
