As you hopefully know, the 2018 Tax Cuts
Act ELIMINATED ALL deductions for
“Business Entertainment expenses.”
Several years ago, the IRS lumped-together
“Business Meals” and “Business Entertainment”
into one category, and called it “Deductible Meals
and Entertainment” [Schedule-C, Line 24(b)]
The 2018 Tax Cuts & Jobs Act specifically
ELIMINATED all Business Entertainment
deductions, as of Jan.1 of this year, 2018.
The Tax Act made no specific mention of
Business Meals, which left us in limbo, with the
question: “What about Business Meals whose
Primary Purpose is NOT entertainment?”
The IRS has (finally) released “Transitional
Guidance” on that subject, meaning it is
temporary guidance we can use while
they are accepting public comments, which
will lead to a final draft.
The Comment Period will end on Dec. 2,
2018, after which the IRS will publish final
“official” guidance in Notice 2018-76…
presumably before the end of 2018.
WHAT DOES THE “TRANSITIONAL
GUIDANCE” ACTUALLY SAY?
The guidance is pages and pages long
(of course – written by IRS bureaucrats).
