1.중국의 가상화폐, 어디를 향해 가고 있는가?

현재 가상화폐 시장에 가장 큰 영향을 주고 있는 중국의 ICO규제관련 기사입니다.
중국의 finance&banking 연구소의 연구원 Hu Bing은 인터뷰를 통해 정부의 ICO 규제는 일시적이라고 주장했습니다. 위 기관은 중국 정부와 관계되어 있으며 연구원들은 정부 기관의 공무원들로 간주되어집니다.

Bing explained that the suspension on ICOs and the government’s declaration of ICOs as an illegal fundraising method are only temporary, until local financial regulators introduce necessary regulatory frameworks and policies for both ICO investors and projects.

Bing는 현지 금융 감독원이 ICO와 관련된 규제의 토대와 정책을 논의하고 결정하기 전까지는 현재 정부가 발표한 모든 ICO 선언이 일시적이라고 말했습니다. 또한 중국 정부가 ICO을 합법화 하게 된다면 뉴욕에서 시행 중인 BitLicense와 같은 프로그램을 도입할 것이라고 말했습니다.

In the official public notice, the PBoC identifies what it refers to as "Essential Attributes of Fundraising Through Coin Offering." It makes note that virtual currencies are not issued through a monetary authority and, as such, lack the characteristics of legal tender, so they cannot be circulated as currency.

다만 중국의 중앙 인민 은행인 PBoC에서 지난 9월 8일 ICO에 대한 입장을 발표한 영문 성명서를 살펴보면, 중국 정부에서는 가상화폐에 대해 다소 부정적인 반응임을 알 수 있습니다.
하지만 중국 정부는 지난 2013년 bitcoin 자체에 규제를 가하는 등 여러 번 거래 중지와 재개를 반복했는데요. 때문에 중국 정부에 대한 ICO규제가 가상화폐 시장에 마냥 악영향이 될지 또는 성장과정에서 겪는 성장통이 될지는 지켜보아야겠습니다.

2. 영국, 말레이시아, 스위스에서의 ICO 반응

UK and Malaysian financial regulators have issued statements suggesting that many ICO token sales may fall under the jurisdiction of local financial regulators, and highlighting the risks associated with ICO investment.

먼저 영국과 말레이시아의 금융감독원은 ICO 관련 투자의 위험을 강조한 주장을 발표했습니다. 하지만 이는 ICO 자체를 문제 삼는 것이 아니라 ICO의 오용을 우려한 주장이라고 볼 수 있을 것 같습니다.

UK’s Financial Conduct Authority Stated That It Is “Keeping a Close Eye on” the ICO Industry

먼저 영국은 ICO 산업에 “계속 주목”한다고 말했습니다. 그리고 ICO와 관련된 위험을 인지하며 ICO를 통해 허가 되지 않은 금융 산업에 대한 규제와 무분별한 ICO투자에 대한 법률 제정이 필요하다고 발표했습니다.
다음으로 말레이시아 증권위원회 SC(Securities Commission)는 외국의 ICO에 진위 확인과법률 규정, 적용의 어려움 또한 불충분한 유동성과 변동성 그리고 투자자들을 위한 법적 보호 등이 아직 마련되지 못한 점과 자금세탁과 테러 자금조달의 수단으로 쓰이는 것에 대해 우려를 표명했습니다.
마지막으로 스위스의 CVA(Crypto Valley Association) 에서는 ICO Code of Conduct를 개발 중입니다. CVA의 회장 Oliver Bussmann는 ICO Code of Conduct가 ICO 산업의 모델이 될 것이라 주장하였고 또한 그는 최근 정부의 ICO에 대한 규제 과정에 대해 관심 있다고 말했습니다.

We believe that token sales represent an exciting, sound and innovative approach to raising investment capital. Therefore, we believe Switzerland should support this trend by developing clear, comprehensible, yet flexible regulation that clarifies the legal status of ICOs and the tokens generated.”

그는 토큰의 정확한 기능과 법적 및 세금 상태를 명확히 하는 것도 중요하며 토큰 판매는 투자 자본을 높이기 위한 흥미롭고 혁신적인 접근 방법이며 스위스가 ICO 및 토큰 생성에 대한 법률 규정을 만듦으로써 이러한 추세를 지지해야한다고 생각한다고 말했습니다.
ICO 규제가 단기적으로 시장에 타격을 줄 순 있겠지만 이러한 과정을 거쳐 규제가 완성된다면 더욱 안정적이고 혁신적인 블록체인 시장이 형성 될 것 같습니다.

3.러시아정부, 적극적인 블록체인 활용

러시아에서는 가상화폐를 합법으로 인정하는 과정에 있습니다. 또한 러시아의 재무 장관 Anton Siluanov 는 최근 모스크바에서 열린 금융 포럼에서, 러시아 정부는 비트코인과 다른 가상화폐 사용자들을 처벌하지 않을 것이라고 말했습니다. 또한 지난해 Vladimir Putin 대통령의 디지털 통화에 대한 승인 이후 러시아 정부의 가상화폐에 대한 시선이 바뀌었음을 명시했습니다.

Siluanov has yet to disclose further details, but merely said that the Russian Ministry’s goal is to make the purchase of cryptocurrencies covered by law to in the same manner as buying treasury bonds and other securities.

심지어 러시아 정부는 현재 목표가 국채 등을 이용하여 가상화폐를 구매하는 것이라고 밝혔으며, 러시아 재무부는 연말까지 가상화폐 합법화를 위한 법안 초안 작성을 시작했다고 말했습니다. 또한 규제의 방식을 증권을 통해 하겠다는 발표와 비트코인 채굴에 드는 전기료를 정부에서 보조 할 것이라는 계획 등을 보면 러시아 정부는 블록체인 기술의 발전에 많은 관심을 두고 있는 것 같습니다.
가상화폐를 규제하는 중국과 장려하는 러시아, 마치 쇄국정책과 근대화과정을 거치는 듯한 두 나라를 보고 있는 것 같습니다.

4.한국에서의 비트코인 첫 판결

우리나라에서도 가상화폐에 대한 정부 기관의 평가들이 속속히 나오고 있는데요. 먼저 지난 5월에 체포된 범죄자의 약 216 비트코인을 정부가 압수하는 것에 대한 판결이 나왔습니다.

“It is not appropriate to confiscate bitcoins because they are in the form of electronic files without physical entities, unlike cash…Virtual currency can not assume an objective standard value.”

판결내용은 “가상화폐는 아직까지 객관적인 표준가치를 지정할 수 없고 때문에 압수대상이 아니다”라는 것입니다. 또한 가상화폐의 가치를 계산하는 것은 어렵기 때문에 경우에 따라 범죄 수단으로 인식되더라도 해당 금액을 계산하여 현금재산에서 몰수해야한다고 말했습니다.

이번 판결을 통해 앞으로 당국이 앞으로 가상화폐 시장에 대해 취할 입장이 어떻게 이루어질지 주의깊게 보아야할 것 같습니다.
