The state wants to buy products

The Central Procurement Agency is seeking to buy Serbia's products to supply some institutions, despite the fact that the Kosovo Government has imposed 100% customs duty on imported goods from Serbia. This Agency, which procures all institutions for labeling the products it intends to purchase, has placed brands of designated manufacturers. The establishment of manufacturers' brands is prohibited by Article 28 of the Law on Public Procurement. This Agency, calling on extraordinary conditions to describe the products it intends to purchase, has referred to specific item of Serbian producers.

In the tender, which is divided into 9 liters and is expected to cost around 23.5 million euros, the technical specifications are also articles: "EuroKrem", "Plazma", "Vegeta", "Pop-Kek", or chicken stand " Argeta ". Some of the products referred to are manufactured in Serbia, to which the Kosovo government has set the 100% tax. Item 7 of Article 28 of the Public Procurement Law prohibits the Contracting Authorities from referring to a specific item or source in the technical specifications.

"The contracting authority shall not compile technical specifications referring to a particular item or source, or a detailed process or any distinctive sign, type or origin or production," reads Article 7, Article 28 of the Law Public Procurement.
