Politics and law that is hard is released

The Politics law of something that is difficult to separate more in Indonesia, this is due to different views and concepts, there is a flow of positivism in accordance with the proposed John Austin who argues that the law is nothing other than a political product or power. This opinion is very much opposed to those who follow the historical flow of legal view not from the dogmatic laws and laws alone but highly dependent socio cultur and where applicable. But the reality in Indonesia is always influenced by the political elite and the power of the government alone, sometimes do not consider the opinion of the flow of history means still strongly embrace the flow of positivism.

Politik Hukum sesuatu yang sulit dipisahkan lebih-lebih di Indinesia, hal ini karena pandangan dan konsep yang berbeda-beda, ada aliran positivisme sesuai dengan yang dikemukakan John Austin yang berpendapat bahwa hukum adalah tidak lain dari produk politik atau kekuasaan. Pendapat ini sangat berseberang dengan kalangan yang menganut aliran sejarah yang berpandangan hukum tidak dari dogmatika hukum dan undang-undang semata tetapi sangat tergantung sosio cultur dan dimana mau diterapkan. Namun kenyataan di Indonesia selalu dipengaruhi oleh elit politik dan kekuasaan pemerintah semata, kadang tidak mempertimbangkan pendapat aliran sejarah berarti masih kentalnya menganut aliran positivisme.

Alhasil setiap produk hukum tidak pernah terlepas politik hukum dalam membentuk suatu perundang-undangan dinegara yang kita cintai, apakah produk tersebut akan mengakomudir kenyamanan masyarakat?ini sangat tergantung sama pemerintah sebagai pengusul produk undang-undang dan sama Legislatif sebagai lembaga yang melegalkan produk undang-undang untuk dijalankan dalam menciptakan keamanan dan ketertiban bangsa.
