Assalamu Alaikum Wa Rahmatullah, I hope everyone is well, I am also well by the grace of Alhamdulillah. I will now write a few words related to the topic of this contest. As much as I have an idea about the subject, I will try to give the maximum. I hope everyone will like this post and my expression. So let's get started without delay.
PART I
Say in your own words and based on what was explained in class: What is Law?
To simply put or define the law, it can be said that the law is a matter where the law is controlled by the state, a state governs the law to protect the rights of the people, and to control the fair and orderly life of the people.
The main reason for making the law is to control the behavior of the people, so that if they do any wrong and commit a crime, the crime can be suppressed by appropriate punishment and law enforcement. And by punishing the offender, crime can be suppressed.
The law can be divided into two main parts:- |
---|
1.Natural Law: It is governed by natural laws such as morality, justice, etc.
2.Law: Laws made by people are man-made laws that are made by people and used by a state for the people, such as criminal law and civil law.
There are some elements of legislation such as, |
---|
Rules: Used to control human activity.
Application: Only the government can enforce the law, to control the behavior of the people.
Punishment: If people break the law, they must be punished.
The purpose of the Act is, |
---|
- Justice.
- Protection of people's rights.
- Ensure equal rights for all.
- Establish discipline.
Look at the explanations given in class, according to the law and laws of your country. Point out two examples of "Objective Law" and two examples of "Subjective Law".
Objective law under the law of Bangladesh:- |
---|
Objective law is mainly used to serve a specific goal and objective of the country, a country uses objective law only when solving a particular problem of society.
Such as:- |
---|
Poverty Reduction Act: This scheme is designed to provide shelter or housing to landless people. So that poverty is alleviated.
Women empowerment: This law has been enacted so that women are not neglected, oppressed, and protected.
According to the law of Bangladesh, subjective law:- |
---|
Subjective law usually takes place around a specific topic.
Such as |
---|
- The Transfer of Property Act, 1882, is subjective law.
- The Bangladesh Contract Act, 1872 It executes contracts and lays down rules regarding the right to contract.
Practical case: Say according to what you have learned, where in the case the Objective Law and the Subjective Law are present.
The presence of objective law, and subject law in the said event is mentioned below:- |
---|
Objective Law:- |
---|
In the above case, the objective law is the duty of all citizens of the state to obey the traffic law, if anyone disobeys this law, then it is a kind of crime. According to the law, if someone does not obey the red signal, then it is a punishable offense.
Every citizen of the country should obey the traffic rules, if someone does not obey the traffic rules, then it is a kind of crime. Objective law is immutable, so it cannot be disobeyed.
Subjective Law:- |
---|
In the said case, the subjective law is an emergency situation or emergency, where the citizen claims that his son is ill so he violated the traffic law, he was in a hurry to get his son sick, it is an urgent humanitarian reason.
If the claim made by the citizen is true, then the concerned authorities should verify the facts and consider the situation. After verifying the facts, if the concerned authorities find that the claim made by the citizen is true, then the citizen can be given immunity.
PART II
Based on what you have explained in class, make a comparison and according to the law of your country. Give an example of a law and an example of a norm
According to my country Bangladesh, I am a 25 year old citizen, the comparison of laws and ideals is mentioned below:-
Example of law:– An example of the law is the traffic law, which is a punishable offense, according to the traffic law, if a citizen crosses the red light, he will have to face punishment.
Example of Ideal: It is an example of moral and ideal to maintain order on the road, it is important to behave in harmony, respect and cordial behavior between the driver and the pedestrians while moving on the road. This will reduce road accidents and maintain discipline.
Comparison by law of Bangladesh:- |
---|
Enforcement Power: The law is an important and mandatory matter, violation of which is a punishable offense.
On the other hand, ideology is a moral matter that there is no punishment for non-compliance.
Intent:- |
---|
The law maintains the rights, security and order of the people.
On the other hand, ideals are moral virtues that maintain respect and harmony among each other.
Analyze and explain in which part of the case Mr. Juan Perez is violating a law and in which part he is violating a norm
In the case mentioned by Mr. Juan Pérez, it is understood that the violation of the law and the violation of the rules is clear.
It is mentioned below:- |
---|
Violation of the law: Mr. Juan Pérez has not paid rent for his apartment for three months, a rental agreement is a legal contract, and disobedience of this agreement is a crime. The owner of the apartment, Mr. Juan Pérez, can sue him for this crime and drive him out of the house.
Violation of rules: Since keeping any kind of clothing animals is prohibited in the apartment, Mr. Juan Perez has violated the rules of the apartment because he is keeping four dogs in his apartment which is causing discomfort to others living in the apartment although it is not a legal offense. This, the concerned authorities of the apartment will solve.
Comparison and Explanation:- |
---|
Violation of law:- Not paying rent on time as per the agreement with the apartment owner.
Violation of rules:- Since Mr. Juan has kept dogs in his apartment which is making others in the apartment uncomfortable and keeping pets in the apartment is prohibited so it is a violation of the rules.
PART III
Explain in your own words what importance Comparative Law has for you according to what you have seen in class.
Comparative law is important to me as a citizen, |
---|
Development of legal framework: If we compare our own laws with the laws of different countries, then we can improve our legal framework.
Multipurpose application: In the multifaceted application of law, we can apply the law in the field of trade, protection of contract rights, etc.
Justice: The laws of each country are made depending on the culture, social system etc. of that country. Comparative law helps to make law more humane and moral.
