Preamble

Good afternoon my fellow steemians how are you guys doing today?. Am happy to be with you people this time around to discuss with you people on a topic that I captioned human rights. I Know you people will be happy to hear from me.

Human Rights

human rights can be defined as those basic natural rights which are essential for human existence. These rights are entrenched in the Constitution and each state grants them to the citizens.
In Nigeria 🇳🇬 the fundamental human rights that citizens enjoy are written in chapter iv of the Constitution of the federal republic of Nigeria (1999)e.g

  • Right to life
  • Right to personal liberty
  • Right to dignity of human

These are some of rights that is written in Nigeria 🇳🇬 constitution of 1999 amendment.

Classification of human rights

1. Natural rights: These can be defined as those rights that a person is born with. Such as right to life.

2 Political rights: These can be defined as those rights that enables a citizen to participate in the political activities and government of his country.
Such as right to vote and be voted for.

3 Social rights: These can be defined as those rights that are connected or deal with the desire of human beings to attract with others e.g right to freedom of assembly, freedom of movement.

4 Economic rights: These can be defined as the right to do business, make profit and invest money such as right to acquire and own property.

5 Legal rights: These can be defined as a situation where the right of a person are voilated and he is aggrieved, he can seek justice, protection or redress from the court of law .

Limitation of Human Rights

  • Illiteracy and ignorance: These two important factors appears to unity the human rights you can only uphold and defend your right if you know them and understand what they are all about. An illiterate and ignorant man will not understand the meaning of fundamental human rights, Even if he dose, he may not know what to do.

  • The law court: The law court can order an accused person to be confined in person until his case is deciding, thereby interfering with right to acquire and own property.

  • Immunity clauses: This is a privilege enjoyed by some political officers which protects them from been prosecuted or been answerable in courts while in office. for the governor of a state can not be dragged to court to answer for himself on cases filed against him. The members of the legislature cannot be charged to court for what they said during parliamentary sessions.
    Even if such utterances assassinates the character of another person. This is called parliamentary immunity and it is a restriction on the right to fair hearing and the right to seek redress in court.

  • Tribunals or special courts: During the military regime, tribunals were used to imprison or punish the critics of
    the regime. Infact, no body trust the judgement of these tribunals or special courts. That is why they are called kangaroo court. This is a limitation to the right to fair hearing.

  • Inadequate indepence of the judiciary: The judiciary is not fully independent since judges are appointed by the executive arms of government. They will like to do the wishes of the person that appointed them and it is in the judiciary that the common man seeks redress when he is aggrieved.

Things that happens during state of emergency

1 During state of emergency period, there is limitation of movement. People are advised to stay indoors and avoid riot and other disturbances. At war time, the movement of the people is equally limited to save lives.

2 Curfew may be imposed on the town which equally restricts the movement of people. When the Curfew is from dusk till down, it means people cannot come out at night.

3 There is lack freedom of freedom of speech: During this period, because fear will grip people and they cannot express the way they feel.

4 There is total breakdown of law and order as people may be killed which violates rights to life.

5 People may commit all types of crime such as rape, looting and arson (which may result in burning of people's homes and places of worship).

6 During emergency periods, people may flee thier homes to other towns and becomes refugees.

Conclusion

My friends is good to know our rights as a citizen of a particular country it will help us a lot. Another one is that when ever there is State of emergency in a state you people should make sure that you obey the rules that is been given by the government so that you will not fall into problem.
