Steemit Engagement Challenge Season8 Week1 : What is the value of life?

in Colombia-Originallast year (edited)
As you said, "Everyone's life has value." That includes the innocent citizens of a society; therefore, to instill a sense of civilization, we need constitutional rules, and that includes capital punishment for serious criminals. I am in favor of a death sentence for the criminals in the rarest of rare crimes.

Capital punishment is a legal punishment by law for anyone involved in a heinous crime. In India, it is given only in the rarest of rare cases.

I know there are views in favor and against and debates all over the world about capital punishment. There are views in favor and against abolition of the death penalty at international level, but we have reached nowhere or any conclusive decision, so the rules are different in different countries. Capital punishment is legal in India, but only in the most extreme of circumstances.

What is capital punishment? The death penalty is considered inhumane and harsh as a punishment, but it is still used and administered for the most heinous and rare crimes, and I believe it serves a purpose to some extent.

Some of the offenses under the Indian Law for which offenders can be punished with death are:

the killing
Robbery
criminal conspiracy
Conspiracies or attempts to wage war against the government

𝕀𝕤 𝕥𝕙𝕚𝕤 𝕥𝕪𝕡𝕖 𝕠𝕗 𝕡𝕖𝕟𝕒𝕝𝕥𝕪 𝕡𝕒𝕣𝕥 𝕠𝕗 𝕥𝕙𝕖 𝕝𝕒𝕨 𝕚𝕟 𝕪𝕠𝕦𝕣 𝕔𝕠𝕦𝕟𝕥𝕣𝕪? 𝔻𝕠 𝕪𝕠𝕦 𝕥𝕙𝕚𝕟𝕜 𝕚𝕥 𝕤𝕙𝕠𝕦𝕝𝕕 𝕓𝕖 𝕚𝕞𝕡𝕝𝕖𝕞𝕖𝕟𝕥𝕖𝕕?

The death penalty has been practiced in India since ancient times. The Indian Criminal Rules, in India, have provisions for the death penalty.

I believe the idea of severe punishment is necessary, as a strict punishment is required to ensure justice for victims, their families, and society as a whole.

The Indian Constitution declares that the protection of life and personal liberty is a fundamental right for all people, so no person should be deprived of his life.

But its legal meaning is that, if a fair and legal procedure is established, the state may punish a person by taking his life.

Deterrence: The argument for deterrence is most commonly expressed in favor of the death penalty. The law enforcing authorities feel that capital punishment help violent crimes under control.

This means that the fear of getting the death penalty if caught will deter a large number of people from committing heinous crimes that they might otherwise have committed.

India is a democratic country that needs strict leagl rules to safeguard and protect its society and keep public faith in its legal system tehrefore we have to enforce certain lawas which might not sound human but inflict a fear against serious crimes.

Arguments against capital punishment in India
The death penalty does not rehabilitate prisoners, which is the basic purpose of punishment.
A punishment is given to the accused with a view to bringing him back to society and allowing him to function as a law-abiding member of the community, but they raise a valid point here. If the person is dead, how can you bring them back into society?

People who oppose the death penalty are of the view that retribution is immoral and a pure form of vengeance, furthermore, data from around the world does not prove that the death penalty reduces crime rates, especially in cases of rape and murder.

The death penalty has been awarded in different cases, including murder and rape, yet the number of cases has not decreased, and in fact, the brutality of rape has increased manifold.

There are opponents of the death penalty who make the argument that it does not provide any solution to the violence in Indian society.

Ignoring social failure: Capital punishment only considers the 'personal failure" of the rapist, turning a blind eye to the "social failures" in the background.

I believe 80% of the prisoners facing capital punishment belong to economically weaker sections.

One of the arguments against the death penalty is that errors or flaws in the justice system can cost innocent people their lives.

Now I'm not sure how our courts determine whether or not a case is considered the rarest of the rare. But the only criterion should be whether the offense is so intense that there is no scope for any other punishment.

And even if the mitigating circumstances are given more weight, do those circumstances warrant the death penalty?

My thoughts on the death penalty
We must take into account the concerns and the manner in which the death penalty is administered, the procedure must be reviewed, and guidelines for determining mitigating circumstances in death penalty cases must be considered.

I know a number of such cases

1: The four convicts in the Nirbhaya gang rape and murder case were hanged in Delhi jail.

In India, there has been a system of capital punishment for heinous crimes since ancient times. Even in religious texts and mythology, there are many stories of criminals being punished with death.

2: Two terrorists convicted in the 1993 Mumbai blasts cases, who killed over 300 people and injured over 2,000 others, were hanged in 2020.

𝕮𝖔𝖓𝖈𝖑𝖚𝖘𝖎𝖔𝖓
I suggest the accused must have an opportunity for a genuine and effective hearing.

The social background, age, and educational level of the convict should be taken into account.

According to me, there should be a death penalty, but only for the eradication of crime from the very roots.

Thanks for your support and wishes 👍That's true, no one is eligible to take a life which he can't give anyways. I appreciate your support!

I fully agree with your point of view. Yes, it is debatable topic but in order to uphold justice in any society, we must impose strict penalties on criminals. However, we must also ensure that our justice system operates fairly for all.

Thanks for supporting my views. In fact, if I were the law maker, I would suggest to eradicate all criminals so the society could live a fearless life.

Thanks!

Every life has importance, not just for humans but also for animals. However, sometimes in Sri Lanka, an innocent person is given the death penalty because of the arguments made by the lawyers. Good luck with the contest.

Thanks for your kind visit and wishes. I agree with the fact that even if a few criminals manage to cheat the law but no innocent should get punished because of shortcomings in rules. However, I believe that once a person is proved guilty of a serious crime he should get what he deserves. Thanks again.

I also agree with you. Have a nice day!
