عدالت نے عطائیوں کے کلینک سربمہر کرنے کا پنجاب حکومت کا اختیار قانونی قرار دے دیاعدالت نے کلینک سربمہر کرنے کیخلاف عطائیوں کی درخواستیں خارج کر دیں جسٹس عائشہ اے ملک نے 29صفحات پر تحریری فیصلہ جاری کر دیاعدالت نے کلینک سربمہر کرنے کیخلاف پنجاب حکومت کا مئوقف قانونی قرار دیدیا پنجاب ہیلتھ کیئر کمیشن ایکٹ صحت عامہ کے تحفظ کیلئے بنایا گیا، سرکاری وکیل صحت عامہ کیلئے عطائیوں کو اڈے چلانے کی اجازت نہیں دی جا سکتی، سرکاری وکیل ہیلتھ کیئر کمیشن ایکٹ کا مقصد صحت عامہ سے متعلق ہر شعبے کو ریگولیٹ کرنا ہے، عدالتی فیصلہ لاہور ہائیکورٹ پہلے ہی صحت عامہ کیلئے احتیاطی تدابیر کا اصول طے کر چکی ہے، فیصلہ صحت عامہ سے متعلق کسی شعبے کو قانون سے ہٹ کر کام کرنے کی اجازت نہیں دے سکتے، فیصلہ ہیلتھ کیئر کمیشن عطائیوں کے کلینک سربمہر کرنے کا مکمل اختیار رکھتا ہے، فیصلہ عطائیوں کے سکلز ڈویلپمنٹ کونسلزسے حاصل کردہ تربیتی ڈپلومے بھی غیرقانونی قرار ایسے ڈپلوموں کی ہیلتھ کیئر کمیشن ایکٹ کے تحت کوئی حیثیت نہیں، عدالتی فیصلہ کے مطابق کو ٹیکنیشن ھومیو ڈاکٹر نرس ڈسپنسر دائی ایل ایچ وی ڈسپنسر کلینک یا ڈسپنسی چلانے کے مجاز ھرگز نہ ھونگے جبکہ سرٹیفائیڈ ڈاکٹروں کو ھی کلینک ھسپتال اور لیبارٹریاں چلانے کے اھل ھونگے سر بمہر ھونے والے کلینک لیبارٹریوں سنٹروں پر رکھے گئے طبی آلات بحق سرکار ضبط کر لئے جایں گے جبکہ جرمانہ پچاس ھزار سے زائد ھو گا جس علاقہ میں غیر قانونی کلینک لیبارٹری سینٹرز چھوٹے بڑے ھسپتال پائے گئے اُس علاقہ کے اے سی ڈی ایچ او ڈرگ انسپکٹر کو فوری نوکری سے برخاست کر دیا جایگا حکم
