That was likely built by a private company but surely paid by a public institution. That company has already, again likely although public institutions pay in a delay term, been paid. If that was requested instead by individuals, the company wouldn't get any money until it is working as expected.

You just did not understand the meaning behind this drain. It is a so-called overflow, which allows the superfluous water to flow off only at a critical water level. ;)
