Reminder for parents during the CPS visit

Hello everyone! In my last posts I told about stories, when CPS took the children because of ignorance of parents. For example, parents signed a voluntary consent to the temporary placement of children in an orphanage. Today I want to summarize someone else's experience and make a kind of memo for parents in case CPS came to you. The first - put a hidden video camera at home, which will always be included. If CPS will catch you by surprise or you will not be at home, and with the children at this time for example will sit grandmother, the video recording will be useful to you as evidence. Now let's go directly to the memo. Perhaps some of the items will seem obvious or ridiculous to you, but when a person gets into a stressful situation, he often forgets just about these basic rules...

1. Never open the door, if you don't know, who is behind it, night time visits should be ignored by you at all.

2. If you see, that there are several people behind the door (the commission) or hear the answer, that CPS came to you, then try not to meet visitors alone. Don't call your name through a closed door. Say, that you can not open the door and themselves urgently call for help, perhaps even a few people – preferably relatives, neighbors and even lawyers. For you the main thing is to show, that you are fully armed and not alone! You can request to postpone and agree with you the date and time of the visit by phone.

3. In Russia, the commission of the CPS can enter the apartment only in two cases: if you allow them or they will present a decision of the Prosecutor. Also, the right to such a visit is the bailiff in the presence of a writ of execution.

4. If you can't reschedule visit of CPS and you have to talk to them, open the door and go to the staircase or the porch. At the same time the child should be at home with your relative or friend. This is important! During a CPS visit, do not allow your child to approach them, hold the child's hand. Completely eliminate the possibility to grab the child and run away from home! This scenario seems fantastic, but now, alas, it is a reality.

5. Ask each visitor to present documents: passport, certificate and decision of the prosecutor on the visit to your family, which indicates the reasons for the visit. Take a photo of all the documents there, right on the stairs, before skipping the commission to the apartment. If the CPS does not allow you to take pictures – rewrite in detail all the necessary data of the documents presented. Necessarily take a photo of the decision of the prosecutor!

6. In addition to the hidden video camera, be sure to make a video or record on a dictaphone, it is desirable, that it should be done by an individual, your assistant, and not you yourself. Warn, that the video will be published! Be aware, that CPS does not have the right to conduct video and audio recording without the official documentary of the permit.

7. After you let the CPS into your home, lock the door with a key, so that no one can leave the apartment without your knowledge. In Russia, it is customary to take off shoes indoors. Strongly ask all present to take off their shoes, first of all it is observance of rules of purity in the house, secondly barefoot to run away with the child on hands - it is quite difficult.

1. All CPS employees must be in your sight, do not let them move freely around your home, look into the rooms and cabinets. This will help you and the people you called or who is present in the apartment. Feel free to ask questions, what the CPS wants to see, why they're looking in the closet. Ask, what they want to see and the rights of the owner of the house show, that you see fit.

2. Very often CPS threaten deprivation you of parental rights. Do not respond to these threats. The procedure of deprivation of parental rights is quite long, it is carried out only through the court and for such a decision need good reason. All threats of deprivation of parental rights or removal of the child ask to repeat in the videorecorder, with a request to clarify on the basis of which the CPS want to deprive you of parental rights.

3. Don't sign anything. Especially often CPS offers to voluntarily place children in a special center, from which you can pick up children " at any time!" That's a total lie. If you read the posts, you will understand, that it is very difficult to take children from such a center. In addition to the results of the visit CPS should make in your presence (!!!) two copies of the "Act on inspection of premises." Make a photo of this act.

4. If CPS offer to go somewhere, for example, to see a doctor - it is better to try to ensure a doctor's visit to the house. If you have to travel with the CPS to the doctor - do not let the child out of the hands, go to the doctor with him, you have the right to be present at all medical manipulations, that the doctor performs with the child. If CPS try to take the child by force to the doctor's office - turn around and leave. If you went anywhere with the CPS, for example to the doctor, continue make the video. Take with you relatives, neighbors, lawyers, those, whom you called at the very beginning. In this case – CPS will not be able to take away the child, it will be more difficult for them to put pressure on you, to frighten, to force to something, to threaten, especially when the video camera is turned on.

5. After the visit of CPS you need to be safe: write to the head of the school or kindergarten a statement demanding not to give the child to anyone except you and your spouse/grandmother/nanny (with their name and passport data), the application should be given on receipt. Additionally, notify all teachers about the same, because now guardianship is increasingly coming to take children to schools and kindergartens. But such a warning may not always help – if the CPS representatives have a formal basis for the seizure of children, the head of the institution will be forced to give the children despite your application.

6. You need to know, that guardianship has the right to take away children only in case of an immediate threat to life or health. If you see, that guardianship allows multiple violations, write a statement to the Prosecutor's office about the illegal actions of CPS employees.

7. Inform about the problem of relatives, the public, the press, make a call to the nearest parent committee and consult. Don't wait for the situation to escalate and let them know from the beginning, that it will be difficult for the CPS to take your child. Show, that you are determined, know your rights and are not going to give up. Immediately contact lawyers and attorneys. Be sure to contact the public, do not stay with the problem alone.

Here's a memo turned out. In my opinion, the most important thing is, that CPS can just steal children, which is why the items are so important, that you should not leave the child unattended during a visit to the CPS home, visit to the doctor and about the application to the school or kindergarten. Also very important is the item about the publicity of your story. We are talking about the press, social networks. Don't waste time and hire lawyers. Do not be afraid to protect your children and your rights, do not ignore the points about the video and audio, because often the CPS provides the court with false documents and certificates, you should have proof of how was happened in fact.
