i just been reading Julia Reda's analysis of the German implementation (proposal i suppose b/c lex actually means "not set in stone" in modern Latin)

The E.U. has voted to pass it , NOW the member states get to apply it (IF they choose to do so ... normally ofcourse they will, especially the poor ones because it's unwise to go against the grain ... bad for your political pension fund and stuff)

But there's leeway - everyone gets to interpret it , meaning, in the less open-sourced (lets call it that) nations ... a lot of actual opinion will be scrutinized for inclusion and removed on claims of

On the other hand, even mighty germany leaves open loopholes (the citizens didnt want it, they made that VERY clear but HEY, sir ... this is not a court of democracy, this is enlightened despotism and the E.U. has spoken ... especially in Merkel country ... since its a bit of her little baby-child, after a fashion, she put way too much time in it to let it all slide
