Let Donna Adelson go - but only until she's convicted!

I don't think Donna Adelson should be in pre-trial detention at all, much less in solitary confinement. Don't get me wrong: I believe she is guilty of commissioning the murder for hire of Florida state law prof Dan Markel. The evidence is overwhelming. But I think pretrial detention should only be used in rare cases where it's the way to protect the community from grave threat and/or the only way to forestall a serious flight risk.

Donna Adelson (an old lady in her 70s) is no threat to the community. She has no meaningful ability to commit crimes on her own, and the circumstances that led her to be willing and able to commission a contract murder are highly unlikely to recur. While she did try to flee the country, her plan was incredibly inept, and future attempts along those lines can be prevented by less draconian means (e.g. - have her turn in her passport and/or wear a ankle bracelet sensor).

If pretrial detention is wrong in this case, solitary confinement is even more so. That should only be done with those who are so great a threat they can't be controlled otherwise (e.g. - Hannibal Lecter). Donna Adelson is a horrible person.

I hope and expect she will be convicted and spend the rest of her life in prison. But she's no Lecter. Surely prison authorities can control her without putting her in solitary.

We overuse pretrial detention in this country, and too lightly lock up people who haven't been convicted of anything.
