Its not through yet. It got over one hurdle. But anyways, it would be far worse than that, memes actualy are least affected. Becouse they are obviously intended to be shared and it doesnt abandon fair use in any way.
It demands an upload filter that filters out any copyrighted material of which you dont hold the copyright or appropriate license to.
And ALL material is copyrighted. If i try to upload a simple picture of myself, guess what? That would be caught in said filter becouse that is copyrighted and ill have a hard time proving that i actualy hold the copyright to it if i have not yet published it elsewhere to establish me as holder of said copyright. Its a total reversal of burden of proof in the area of copyright.
Oh and, speaking of, this comment of mine would also have to be filtered to be on the safe side, its not like text cant rise to the level of being copyrighted.
Obviously it would require the post to rise to the appropriate levels of creativity required to be copyrighted, problem is, that cant really be easily established. If it is creative for the standarts of the author thats enough.
Though, admittedly, courts typicly dont agree that porn can possibly be copyrighted in germany due to the supposed lack of creativity.
