The problem is not whether bitcoin is a currency or not. The problem is that this man agreed to a contract - a contract where he agreed to plea guilty to running a money service business without a license. He agreed to that and the courts held him to his agreement and would not let him out of the contract by changing his plea. It is a contract issue not a currency issue. All he had to do was rebut the courts assumption that he was running a money service business without a license by stating that he traded bitcoin and every trade had nothing to do with currency - it is the same as trading baseball cards. The courts knew this but maneuvered him into a position with the help of his attorney to admit and agree that he was trading currency. That agreement is going to cost him 3 1/4 years of his life and the courts will make money during that 3 1/4 years - so the court is happy. The courts are about making money; not about justice but about just us.
