"Equity in the Criminal Justice System" - Kaos1973

The official policy of the Queensland government is "Equity in the Criminal Justice System".

This means that those over represented in courts and jails have to do more crime to be incarcerated than those that do less crime so that the numbers of different racial and cultural groups are more equal. It is a policy of treating the symptom of racial differences rather than the cause.

This flies in the face of the foundational principal of equality before the law.

Our society MUST have equality before the law because lady justice MUST be blind. She can not peek out to see what colour skin the defendant has, or what gender, or social position. Because as soon as she does that the law becomes a servant of whoever writes the equity provisions.

It also creates by definition a privilege class of offender that receives lenient treatment from the courts and conversely a persecuted class that receives more harsh treatment.

For example: Indigenous offenders receive all manner of diversion programs and opportunities to avoid the court system that are not available to the wider community because for only 10% of the state population they equate to more than 70% of the prison population.
Caucasians represent a small but significant portion of the prison population and so cop the full force.
Asians are greatly under represented in the courts and prison system and therefore MUST be severely dealt with in order to bring their numbers closer to the other groups.

Don't believe me go down to Arrest Court One in any regional court house and tally up all the sentencing results.

If we can not address the racial differences between various groups than we must continue to follow the dogma that everyone is equal and some just need more government intervention to prove that - at tax payers cost.
