See common law rights. Technically DC is legally intended to be a seperate entity than the fifty states. So statutes and those at large are imposed upon the 10 mile area and US citizens (different than citizens of the United States of America).

Outside of DC, what I said would be in fact valid. As every state has to adopt or allow common law to be valid.

Im not refuting you vlad, just trying to clarify where I came from with the answer.

Yup. Basically, I was writing about a general principle, regardless of the jurisdiciton, while you were referring to a specific juridical situation and the legal principles that govern a certain area.
Anyway, thanks for the info, I wasn't aware of DC's status.
