ILLEGAL LOGGING


Illegal logging is the harvest, transportation, purchase or sale of timber in violation of laws. The harvesting procedure itself may be illegal, including using corrupt means to gain access to forests; extraction without permission or from a protected area; the cutting of protected species; or the extraction of timber in excess of agreed limits.

Illegalities may also occur during transport, such as illegal processing and export; fraudulent declaration to customs; the avoidance of taxes and other charges, and fraudulent certification.

CAUSES

The causes of illegal logging are manifold. Weaknesses in forest governance in producer countries are typically the direct cause. However, consumer countries contribute to these problems by importing timber and timber products without ensuring that they are legally sourced.

Governance problems include weak institutions and limited resources, which results in a lack of law enforcement as well as limited capacity for land use planning. In many countries the legal framework is unclear or contradictory, making it difficult if not impossible to operate legally. In some situations, the law is not accepted, for example, where the government is considered illegitimate or where customary law holds sway and the formal legal system conflicts with this.

EFFECT

There is too much effect this are flood tragedy one of a problem which is not solved by our government and human. Every year, sea surface is higher than land surface. The sea surface will rise from 1 to cm level. Flood tragedy is a filling land ( soil surface) because one of a hard rain which is continues every day. So, the water in the river can flow to the land. Unfortunately, the flood tragedy has negative effect such as many people who died; many homes which is filling a place ant not flowing, and then the flood washed away many homes, plants, and pets. Many people are afraid with flood tragedy. But we cannot give up. We have to positive something. 

HOW TO ERADICATE/ LESSEN THE PROBLEM

Illegal logging is the most pressing environmental issue for those whose communities, natural resources and livelihoods are dependent on forestry. Putting legislation in place to prevent illegally logged wood finding its way into mainstream markets is a very clear opportunity. This legislative support goes hand in hand with the direct support we are providing to forestry communities who seek to protect their resources and their lives and livelihoods. The combination of the practical and the political is Progression’s way of doing things. It’s an important sign of our solidarity with those who are living with the injustice that is illegal logging. We work with farmers and communities who struggle to make a living from their land because of the impact of deforestation, who face violence and intimidation from the loggers and who battle with the corruption of officials who turn a blind eye. All this is possible because there is a demand and market for the wood. There are four main ideas to solve that problem. First of all, we must do deforestation system at the infertile. Second, soil conservation. Third, prohibition to burning forest. Finally, prevent filed agriculture movement.

PRESIDENTIAL DECREE No. 330

PENALIZING TIMBER SMUGGLING OR ILLEGAL CUTTING OF LOGS FROM PUBLIC FORESTS AND FOREST RESERVES AS QUALIFIED THEFT

WHEREAS, public forests and forest reserves are important natural resources of the country which must be preserved and conserved for future generations;

WHEREAS, public forest and forest reserves are the vital source of logs and other wood products so essential to the national economy as principal dollar earner of the country;

WHEREAS, it is the solemn duty of every citizen to protect public forest and forest reserves from indiscriminate logging, senseless denudation and wanton destruction to the detriment of the present and future generations;

WHEREAS, there is need to discourage further forest destruction and denudation in order to conserve the remaining public forest and forest reserves for the patrimony of the country;

Now, Therefore, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution as Commander-in-Chief of all the Armed Forces of the Philippines, and pursuant to Proclamation No. 1081 dated September 21, 1972, and General Order No. 1 dated September 22, 1972, do hereby order and decree:

Section 1. Any person, whether natural or juridical, who directly or indirectly cuts, gathers, removes, or smuggles timber, or other forest products, either from any of the public forest, forest reserves and other kinds of public forests, whether under license or lease, or from any privately owned forest lands in violation of existing laws, rules and regulation shall be guilty of the crime of qualified theft as defined and penalized under Articles 308, 309 and 310 of the Revised Penal Code; Provided, That if the offender is a corporation, firm, partnership or association, the penalty shall be imposed upon the guilty officer or officers, as the case may be, of the corporation, firm, partnership or association, and if such guilty officer or officers are aliens, in addition to the penalty herein prescribed, he or they shall be deported without further proceedings on the part of the Commissioned of Immigration and Deportation.

Sec. 2. All laws, rules and regulations inconsistent herewith are hereby repealed or modified accordingly.

Sec. 3. This decree shall take effect immediately after publication in the Official Gazette or in a newspaper of general circulation in the country.

Done in the City of Manila, this 8th day of November, in the year of Our Lord, nineteen hundred and seventy-three.
