The Legal Battle For CBD Freedom

At the end of last year, the US Drug Enforcement Administration (DEA) decided to make the move to announce that they were implementing new rules surrounding cannabis. With those new rules came the surprising new restriction against all cannabinoids, which includes CBD extracts, making them a Schedule I drug.

This upset many folks for a number of reasons, aside from the obvious violation to natural rights, but there are millions of people who use CBD to treat a variety of physical ailments; they don't know what they'd do without it.

A number of doctors have been treating patients for years with CBD oil, namely children with epilepsy because it's been known to help with seizures.

And CBD products don't have the THC compound which produces any sort of high to the user. Given that so many families and individuals are finding remedy with this product, it's safe to assume that these new restrictions will only cause more harm than any supposed good, to prevent people who need this from being able to get it.

Many companies have been producing non-THC cannabis extract products for years, and this new rule change would make those farming industrial hemp for CBD products in violation of federal law.

It didn't take long for lawsuits to be launched in response to the reclassification.

The Hemp Industries Association (HIA) along with at least 2 other companies has already filed a lawsuit against the DEA to challenge their rule change. In a document pertaining to the case that was obtained a few weeks ago, it was reveled that the HIA was arguing that the agency had abused its authority in failing to follow necessary steps in scheduling new drugs under the Controlled Substances Act.

They say that there is no legal basis for the DEA to make this rule change to the code, banning cannabis extracts like CBD products in this way. They argue that the DEA doesn't have any solid justification for doing this and for criminalizing cannabinoids, especially given as so many people have already proven to be helped by them.

Cannabis advocates argue that to lump CBD in with THC and to assume that they are the same or provide the same experience, is a rather ignorant move to make. Though they are still sorting the issue out in court, many are hoping that the courts will reaffirm that CBD and other cannabinoids should not be categorized as controlled substances federally and therefore the DEA should have no jurisdiction in that area.

The next step is for the DEA to file their response by June 2nd.
