Dear Mr Foley

Thank you for your email of 31 January. I can confirm that we are considering an application from Ryanair for an Operating Licence, but that licence has yet to be granted.

While I appreciate the points that you make, the basis on which we consider such an application is tightly laid out under UK and European law, namely the Civil Aviation Act 1982 and Regulation (EC) 1008/2008.

That legislation requires us to be satisfied that an applicant can meet a range of criteria, in particular in relation to its safety and insurance arrangements, and its financial solvency. Although we would consider in any licence evaluation whether an applicant has appropriately qualified crew, unless they have, or are likely to have, a direct impact on safety the terms of their employment are a matter for the company and their employees, or the agency with whom they each may contract.

Consequently, subject to my point above, we can only consider an application on the basis of the licensing criteria alone. We have no role in relation to the company’s employment arrangements and could not refuse an application on such grounds.

However, in seeking an Operating Licence Ryanair has established a UK company for that purpose. Such a company is of course subject to normal UK employment legislation requirements.

Dear Dame Deirdre Hutton, I am in contact with you today regarding Ryanair 's application for a UK air operators license aftert Brexit. I would hope the CAA would revoke this License till the employment investigation has taken place regarding the 3,500 Ryanair employees with the vast majority being probationary cabin crew contracted through agencies, Crewlink Ireland and Dalmac's Workforce International. You will be aware Work and Pensions Committee, Business, Energy and Industrial Strategy Committee Chair Rt Hon Frank Field has written to HMRC's Jon Thompson and Director of Labour Market Enforcement Sir David Metcalf asking them to investigate Ryanair,Crewlink Ireland and Dalmac's Workforce International. This investigation will ensure Ryanair,Crewlink Ireland and Dalmac's Workforce International are paying the UK Minimum Wage to the 3,500 Ryanair employees working in the UK. These investigation will cover a wide range of issues regarding probationary cabin crew employment working in the UK.
