Be Good, Do Good And Work Good
Why do we need to stand for Chief Justice Sereno?
Philippines is democratic form of government with the three branches namely the executive, legislative and judiciary. This three branches exercises separation powers following the principles of check and balance. Thus, every branches is co-equal with the other. Now, the question would be why there are a lot of moves from the executive to overthrow the existing chief justice Sereno? Could there be political reasons?
Chief Justice Maria Lourdes Sereno faces three major fights that wanted to overthrow her as Chief Justice these are: impeachment complain filed in Congress; quo warranto petition questioning the legality of her position; and the call for her resignation from the people who justify that it is for the purpose of saving the integrity of the Supreme Court.
CJ Sereno stand firm and strong that she will not go down or resign as Chief Justice thus confirming her right to fight against all cases of impeachment filed on Hearing Committee on Congress wherein majority are President Duterte's allies.
"I ask only one thing from the political leaders, only one thing: Give me my day in the Senate impeachment court or admit that there is no probable cause,"
Base on the 1987 Constitution its only through the process of impeachment that the following person holding positions as President, Vice President, members of the Supreme Court, Constitutional Commission, and Ombudsman.
Solicitor General Jose Calida filed against CJ Sereno quo warranto petition or questioning the legality of the appointment of CJ Sereno upon the failure of CJ Sereno to submit her Statement of Asset, Liabilities, and Net Worth/SALN from the time she applied for the position in the year 2012.
This is the first time in Philippine history that the Chief Justice of the Supreme Court faces quo warranto. Five members of the Supreme Court these were Associate Justices Teresita Leonardo-De Castro, Diosdado Peralta, Lucas Bersamin, Francis Jardeleza, and Noel Tijam who have release negative remarks against CJ Sereno in the House Justice Committee hearing in Congress. They will also judgr the quo warranto petition of the Supreme Court.
Why does the Duterte administration strongly pursuing the oust of CJ Sereno?
First CJ Sereno, openly addresses her judgement against the majority decision of the Supreme Court of the cases that had something to do with President Duterte's wants like the influence of the President to free former President Arroyo from the cases of plunder, declaring that its constitutional for the former President Marcos to be buried in the "Libingan ng mga Bayani," and the declaration of martial law thus even extending it for one year.
The move to remove or oust CJ Sereno is a means of finding and putting someone in the Supreme Court who is an allied with the President. This only means that people who do not support the program and policies of the present administration can be remove in office, if they can do this with the Chief Justice thus there is no reason they cannot do it with the criticizers of the administration or any ordinary civilian who wanted to voice out their grievances in the government.
It is important to take note that the three branches of government are co-equal in terms of functions and importance. It is essential that each branch of the government possess there own objective decision pertaining to the conduct of a democratic government.
Reflection:
As one people under one government let us all remember the importance of unity. It is by all means that the people holding powers in the government must know the importance of unity towards progress. This is not the time to be divided but a time to be one, working for the common good of the people, nation and country. It is a simple call to make things of great for the glory of God and His people. It is the natural order for people to do what is good, be good, do good and work good!
