Pfizer Exec Arrested On Child Pornography Charges
A Pfizer vice president has been arrested on charges of receiving, possessing and distributing child pornography. Alan Hesketh, 61, was arrested at JFK airport by federal agents Wednesday and is being held without bond, reports the newspaper The Day.
Hesketh, who works on patent issues in the firm's offices in New London, Conn., is currently on leave from the company, a Pfizer spokesman told the WSJ . The company is "cooperating fully with authorities," the spokesman added.
A call from the WSJ Law Blog to Hesketh's lawyer wasn't immediately returned this morning.
Hesketh is accused of posing as a 28-year-old woman in online chats while trading images of children engaged in sexual acts, according to a court document filed in the case. He signed on as "Suzybibaby" from his home, as well as from an Internet address registered to Pfizer in New York.
If indicted and convicted, he could face a mandatory minimum of five years in prison, a maximum of 20 years for receiving and distributing child pornography and a maximum of 10 years for possessing child porn, the WSJ Law Blog says.

Ex-Pfizer Exec in Child Porn Case Must Pay $200,000 to Victim
A judge has ordered a former Pfizer executive convicted of distributing child pornography to pay $200,000 to a girl whose images he downloaded.
It is the first time that restitution has been ordered paid by someone who consumed child pornography but did not themselves abuse the victim, according to The Day.
The court appears to have chosen Alan Hesketh, the former global patent dirctor at Pfizer, for this novel new punishment simply because his work at the company had made him wealthy. Hesketh is also serving a 78-month prison sentence. He previously worked at Glaxo Wellcome in The UK. Hesketh was caught with nearly 2,000 child porn images. He was fired by Pfizer last March.

Judge [Warren] Eginton said that after he reviewed the law, restitution appeared to be mandatory in this case. He then considered Hesketh's financial position, having looked at a sealed report prepared by the probation department.
The court examined Hesketh's ability to pay:
He paid $834,000 for a 3,371-square-foot colonial at 202 Montauk Ave. in Stonington in 2003. He also owns homes in New York, England and the Isle of Man.
Judge Eginton said that after he reviewed the law, restitution appeared to be mandatory in this case. He then considered Hesketh's financial position, having looked at a sealed report prepared by the probation department.
"The ability to pay ... even with this depressed market, is probably there," said Eginton. He indicated that, if necessary, he would extend the restitution order over a period of time so that Hesketh's family is not forced to sell the properties until real estate prices recover.
Hesketh's lawyer said he will appeal the verdict on the grounds of its novelty and because there is no proof that the girl in the photo is the girl Hesketh has been ordered to pay money to.

Alan Hesketh, a 61-year old British citizen living in Stonington, Conn., was sentenced Friday in U.S. District Court in Bridgeport. He pleaded guilty in July to one count of receipt and distribution of child pornography.
"It was a fair sentence under the circumstances," said Jonathan J. Einhorn, Hesketh's attorney. "When you consider all the good he's done in his life and you consider the whole picture of Dr. Hesketh as a person, it's an appropriate sentence."
This is what he did. . .Authorities say that from June 2006 to May 2007, Hesketh used Google's now-defunct "Hello" program to exchange hundreds of images of child pornography and to engage in online "chats" about the sexual molestation of children.
Prosecutors say he posed online as a 28-year-old woman nicknamed "Suzibibaby" while trading the images, many of which included prepubescent and pubescent minors engaging in sexually explicit conduct with adults and other minors.

- Hesketh is currently being held at a Rhode Island detention center after being arrested by Federal agents on March 26 for possessing, receiving, and distributing child pornography.
According to Federal agents, Hesketh and a Buffalo, NY, deli worker exchanged 85 pictures, which included infant molestation, during at least one “chat” session. Hesketh reportedly told Federal authorities that he conducted his child-porn activities, under the female persona of “Suzibibaby,” at his New London home, at work, and on business trips.
During travel, Hesketh allegedly carried more than 1000 child-porn images on 3 compact flash drives.
Hesketh was hired by Pfizer 6 years ago and was fired as patent director from the company on March 28. Without commenting specifically on Hesketh’s case, Pfizer spokesperson, Liz Power, was reported to say that “the company does not allow employees to use computer resources or systems that contain or promote abusive or objectionable language or information that is illegal or obscene.” “[A] number of technical controls block objectionable web sites, prevent peer-to-peer file sharing, and remove unapproved software,” according to Power, and she indicated that “systems” are scanned several times a year.
Hesketh, a British citizen, was denied bond after the judge learned that he owned multimillion-dollar properties throughout the world.
A motion filed April 4 indicates that Hesketh’s attorney and the US Attorney’s office are negotiating a plea deal. A probable cause hearing that was scheduled for April 10 did not take place.
According to a spokesperson for the US Attorney’s office, most of those convicted in child-porn cases are sent to prisons that have medical hospitals with sex-offender programs; the 2 named were Devens in Ayer, MA, and Butner in North Carolina.
Hesketh, 61, has been married for 39 years and has 4 adult children and 5 grandchildren. According to Hesketh’s wife, the couple are “on the verge of divorce.” Reports indicate that she has known little-to-nothing of their finances.
Before working for Pfizer, Hesketh was an executive at then Glaxo Wellcome in England.

Factual Background
Plaintiff–Appellant Jane Doe (formerly known as
Masha Allen) was adopted from Russia by Defendant–
Appellee Matthew Alan Mancuso when she was five years
old. Over the course of the following five years, Mancuso
sexually abused Doe and documented the abuse in a series of
photographs and videos. Mancuso copied these media and
distributed them through chat rooms on the internet in
exchange for media documenting the sexual abuse of other
children. Mancuso’s photographs and videos became popular
among viewers of child pornography and he was
subsequently arrested after a law enforcement investigation
identified him as Doe’s abuser. Following his arrest, a
federal grand jury in the Western District of Pennsylvania
returned a two-count indictment against Mancuso: count one

charged Mancuso with sexual exploitation of a minor in
violation of 18 U.S.C. § 2251(a); and count two charged
Mancuso with possession of material depicting the sexual
exploitation of a minor in violation of 18 U.S.C.
§ 2252(a)(4)(B).

A British business executive jailed for possessing thousands of child pornography images has been ordered to pay £138,000 to a sex abuse victim whose pictures were found in his collection.
The case against Alan Hesketh, a 61-year-old Briton living in Connecticut, is the first of its kind in the U.S.
His lawyers argued that he had never met the girl, aged eight, when the photographs were taken, and was merely a 'consumer'.
Prosecutors told the hearing in Bridgeport, Connecticut, that the girl had been sexually abused by a relative for a year and forced to take part in pornographic photo sessions.
They said she had suffered a decade of 'insult and embarrassment' as the pictures were distributed among collectors.
Hesketh had four images of the girl on his computer's hard drive when he was arrested at New York's Kennedy Airport last March.
The father of four was dismissed from his position as Pfizer's vice president and global patent director after the arrest and was sentenced to six-and-a-half years' jail in October.
She was one of 24 victims identified among the thousands of images Hesketh stored on his computer.
Hesketh's lawyer Jonathan Einhorn has announced an appeal, saying there was no legal precedent for awarding compensation against someone who had not participated in producing the pornography.

Using the name 'suzbibaby', he sent and received the images from his £500,000 house in wealthy Stonington, Connecticut, and from an internet address registered at Pfizer's Manhattan headquarters.
Hesketh is understood to own several properties in the Isle of Man as well as homes in New York and Connecticut worth millions of pounds.
The court heard that Hesketh, who worked as a patents lawyer in the UK before moving to America seven years ago, had traded 1,067 images with a man from Buffalo, New York, of children engaged in sexually-explicitly conduct with adults.

Reading out the charge, Judge Eginton said: 'The children were under the age of 12 and involved in sadistic and masochistic acts.'
Debra Slater, prosecuting, said the child advocacy group, Just For All, had managed to trace some of the children, who had been reported missing by their parents.

A secret Nigerian government report concluded that the drug manufacturer Pfizer undertook an “illegal trial of an unregistered drug” when the company enrolled nearly 100 Nigerian children with meningitis in a trial testing its antibiotic trovafloxacin (Trovan) against ceftriaxone during a 1996 meningitis epidemic.
Families of the children, their attorneys, and the media have been seeking the results of the report for five years without success until the report was leaked last week to the Washington Post
The Washington Post article said that “aspects of the affair remain mysterious, such as why the report remains confidential.” The head of the investigative panel behind the report, Abdulsalami Nasidi, a virologist and senior Nigerian health official, told the Washington Post he did not know why the report was never released. The panel was set up in 2001 to determine whether the trial was conducted legally.
A class action suit filed on behalf of the children’s families in a federal court in New York alleges that Pfizer did not inform families that trovafloxacin was an experimental treatment and that it failed to obtain informed consent.
Court documents filed by the plaintiffs said that “most tragically, Pfizer purposely … low-dosed the control drug” and did not tell families that free, approved treatment was available at the same hospital from Médecins Sans Frontières.
The plaintiffs cited, in turn, a whistleblower lawsuit filed by Juan Walterspiel, a former associate medical director of Pfizer’s central research division, who had responsibility for international protocol development. Dr Walterspiel claimed that Pfizer fired him after he warned the company—before and after the study was conducted—that the study methods employed by Pfizer in the Nigerian trial were “improper and unsafe.” Dr Walterspiel’s action has since been settled.
Bryant Haskins admitted, in an email message, that the daily doses of ceftriaxone given to the children in the study had been reduced by two thirds, from 100 mg per kg to 33 mg per kg, he claimed they still “significantly exceeded the recommendations of the WHO.”
adding that the doses used by Pfizer far exceeded the dose needed to kill meningococcus in cerebrospinal fluid.
So why didn't Pfizer win FDA approval to use trovafloxacin to treat meningitis in light of its claimed superiority?
Trovafloxacin was withdrawn from European markets after reports of fatal liver disease and since 1999 has been recommended only for emergency use in the US.
Trovafloxacin was not approved for use in the United States when it was tested on the children in Nigeria
The 2001 government report, which is contested by Pfizer, found that “although the protocol mentioned the possibility of elevated liver enzymes . . . it did not consider carrying out any liver function test either before or after the treatment.”
Five of 93 children in the trovafloxacin arm died, and six of 97 in the ceftriaxone arm died, according to Pfizer.
The study, which was only published as an abstract, shows that 10 of the children enrolled in the study were excluded from the analysis. Pfizer did not respond to queries by the BMJ about the outcomes of those 10 children.

Officials say 48-year-old Reinaldo Diaz Camacho was charged after Puerto Rico police received information that he was having sexually explicit conversations with a 16-year-old boy on Facebook.
U.S. Attorney Rosa Emilia Rodriguez said Thursday that the boy's mother told authorities she had seen the conversations on her son's cellphone.
Rodriguez says Diaz had sent the boy sexually explicit images via Facebook and text messages. She says a federal agent then posed as the teen on Facebook and continued to interact with Diaz. She says Diaz asked the boy to send naked pictures of himself.

On May 6, 2013, Homeland Security Investigations (HSI), San Juan, Puerto Rico, Cyber Crimes Group (CCG) received information from the Puerto Rico Police Department (PRPD), Sexual Crimes Division (SCD) in Fajardo, PR regarding an adult male who was engaging in sexually explicit conversations with a 16 year-old male minor via Facebook.
On that same date, the victim’s mother was interviewed by HSI Agents. During the interview, she explained that earlier in the day she had seen a sexually explicit conversation between her son and Díaz-Camacho on the minor’s cell phone. The forensic examination of the minor’s cell phone revealed the presence of sexually explicit images. The minor had received sexually explicit images from Díaz-Camacho via Facebook and text messages.
After receiving consent from John Doe’s mother, an ICE-HSI Special Agent assumed the identity of the minor on Facebook and continued the conversation with Díaz-Camacho. During the conversation via Facebook, Díaz-Camacho requested that the minor victim send him nude images of himself.
Diaz-Camacho was brought before U.S. Magistrate Bruce McGiverin for his initial appearance, whereupon he was ordered temporarily detained in the Metropolitan Detention Center in Guaynabo awaiting the outcome of his case. If convicted, he faces a mandatory minimum sentence of 15 years incarceration and a possible maximum statutory sentence of 30 years incarceration. The case is being prosecuted by Assistant U.S. Attorney Marshal D. Morgan.

Authorities say that from June 2006 to May 2007, Hesketh used Google's now-defunct "Hello" program to exchange hundreds of images of child pornography and to engage in online "chats" about the sexual molestation of children.
Prosecutors say he posed online as a 28-year-old woman nicknamed "Suzibibaby" while trading the images.
According to Federal agents, Hesketh and a Buffalo, NY, deli worker exchanged 85 pictures, which included infant molestation, during at least one “chat” session. Hesketh reportedly told Federal authorities that he conducted his child-porn activities, under the female persona of “Suzibibaby,” at his New London home, at work, and on business trips.
During travel, Hesketh allegedly carried more than 1000 child-porn images on 3 compact flash drives.
Hesketh was hired by Pfizer 6 years ago and was fired as patent director from the company on March 28.
Federal agents believe Hesketh used the screen name “Suzybibaby” during online sessions at home and at other locations, including one at the Tudor Hotel at the United Nations in December 2007, according to a report at TheDay.com.

Factual Background
Plaintiff–Appellant Jane Doe (formerly known as
Masha Allen) was adopted from Russia by Defendant–
Appellee Matthew Alan Mancuso when she was five years
old. Over the course of the following five years, Mancuso
sexually abused Doe and documented the abuse in a series of
photographs and videos. Mancuso copied these media and
distributed them through chat rooms on the internet in
exchange for media documenting the sexual abuse of other
children. Mancuso’s photographs and videos became popular
among viewers of child pornography and he was
subsequently arrested after a law enforcement investigation
identified him as Doe’s abuser.
