A Third Bill of RightssteemCreated with Sketch.

“Rightful liberty is unobstructed action according to our will within limits drawn around us by the equal rights of others. I do not add ‘within the limits of the law’ because law is often but the tyrant’s will, and always so when it violates the rights of the individual.”
-- Thomas Jefferson

The American Founding Fathers added the Bill of Rights as an afterthought to the Constitution. Barak Obama wanted to add a second bill of "negative rights", constitutional scholar that he is. After observing our unelected deep state government for some time now, I think it's about time to get a few more rights cast into constitutional jello. They are nothing that is not already guaranteed there, but some authorities seem to need to have things spelled out for them. Here's the next batch I'd like to see considered...

We hold these additional truths to be self-evident. That all people are created equal and are endowed by their Creator with the certain inalienable rights... To secure these rights, governments are instituted among men, deriving their just powers from the consent of the governed. Whenever a government becomes destructive to these ends, it is the right of the people to alter or abolish it.

  1. All people have the right to be left alone by their government if they aren’t violating someone else’s rights. This is the only reason governments are instituted among men in the first place – to secure these rights.

  2. All people are equal under the law and if an activity is legal for some people it must be held legal for all people. It cannot be right that Paris Hilton can buy securities but patent examiner Albert Einstein could not.

  3. A person has the right to decide for themselves which risks they are willing to accept without government interference. If I can sky dive, rock climb and engage in unsafe sex, why can’t I gamble and buy unregistered securities?

  4. If people have the right to take personal risks in one activity, they have the right to take lesser risks in other activities. Which is riskier, a state-run lottery (99.9999% probability of loss) or purchasing a token for a stake in someone else’s open source code? Governments have the free speech right to warn us of risks, not prevent us from taking them.

  5. People have the right to make innocent mistakes until they have been properly warned of their error and to appeal the government’s interpretation of all applicable laws without being preemptively deprived of their lives, their fortunes or their sacred honor.

  6. People have the right to the benefit of the doubt in areas where the law may be undefined or unclear. In the current maze of unclear and undefined regulations in which multiple agencies have themselves not agreed on how to treat a particular issue, ignorance of the law is absolutely a valid excuse.

  7. No citizen shall be deprived of their chosen legal counsel by preemptive seizure of their assets. People who cannot afford competent legal representation shall not have their assets seized by the government without fair and competent instruction by the government on where and why they are not in compliance with a transient or evolving government interpretation of applicable law and the opportunity to appeal that interpretation.

  8. The government shall not take action against a citizen based on unsubstantiated rumors or the mere possibility that a law is being violated.

  9. The right to a fair trial includes a level playing field wherein neither side has access to unlimited resources. To ensure this, the government must provide an accused with defense resources equal to what it is spending to prosecute them.

  10. The use of deadly force in surprise raids shall only be applied when all other alternatives have been exhausted.

  11. While endeavoring to protect one group of people the government shall not inflict harm upon another group of people. Seizing investor assets and holding them for years of litigation wherein they cannot properly protect their investments by quickly redeploying them, inflicts guaranteed damage under the guise of preventing the mere unproven possibility of damage.

  12. A government does not own its citizens. It has the rights granted to them by the people who formed it to enforce its laws on people living within its jurisdiction and no right to enforce its laws on people outside its jurisdiction regardless of whether they are citizens or not.

  13. All people have the right to choose the jurisdictions under which they will live without regard to their place of birth. Voting with your feet is a fundamental right.

  14. Virtual reality and cyberspace, like international waters, airspace and outer space, is a domain free from the control of any individual government.

  15. The government shall not preemptively destroy a company, harm its supporters, or defame its reputation without due process.

  16. The probability of being harmed by the government shall not be allowed to exceed the probability of being harmed by criminals and terrorists.

I'm sure there are a thousand other things that the governments of the world are doing that they have no granted authority to do.

Let me know what you think.

These are EXCELLENT!
They really hit home for anyone involved in the cryptospace. The examples chosen really resonate with me at least.
One thing I'm pretty happy about is that in the past 10 years I've seen my views gain more and more popularity. To the point where I feel less and less special because I can see these ideas go mainstream haha. At least I get to feel like an avant-garde hipster though :D
For example, I see some of my Facebook memories which made people go apeshit in 2008 pop up now that seem trivial today. Culture is evolving FAST!

10 years is a long time.
i want to ask, is muse is your creation coin?
i need more knowledge about cryptocurrency.
thanks @cob

10 years goes by fast! Change like we see today used to take centuries. The speed to innovation and societal change is accelerating greatly.

Yes, Muse came out of PeerTracks inc's work for the last few years.

https://museblockchain.com

I've been muse for a few days.
But I can not understand perfectly yet.
But I will always learn.
I've also made some posts about muse.
but no one has responded to my post.
maybe, my post is not good.
However, I will still learn to understand
and i will re-create the post muse.
thanks @cob.

Give it 5 more years and then you'll come to the time it took for the Bill of rights to be ratified to the oxymoronic constitution that didn't see slaves and Indians as men, TJ wanted badly to add an amendment to secure the rights of slave owners.. That fucking hack can eat my shit for eternity.

I believe in crypto secession :-)

I love these but still think there is the MOST IMPORTANT one missing (as it is for the Bill of Rights in the US)............ namely that should be:

  1. BEING THAT THIS CONSTITUTION IS THE SUPREME LAW OF THE LAND AND IS WRITTEN TO "CONTROL GOVERNMENT", IT IS SELF EVIDENT THAT A FREE PEOPLE CAN NOT HAVE "LAWS" THAT REGULATE OR FORCE THEM INTO OR OUT OF ANY ACTION (civil lawsuits on matters of value over one ounce of GOLD are triable by a JURY of peers), ALL LAWS ARE TO DELEGATE RESPONSIBILITIES AND RESTRICT POWERS OF GOVERNMENT OFFICERS,,,,,, this is what we call "RULE OF LAW",,,,,, where the PEOPLE are FREE and the SERVANTS are restricted BY LAW in their use of force (by the noose if necessary).

Yeah but people back in those days used Logic and Reason and you didn't need to explain the obvious, even though 100 years later idiots like Spooner thought that the Federal Owed them something, least an explanation for their insinuation that there is no Rule of Law.

Yes, it would seem so obvious to the discerning eye. Too bad the 2 party system was created to usurp and take the agenda away from the people allowing for the deception of law and the downfall of the grand experiment in freedom of and for the masses.

The fault always lies with the Public who did nothing in the face of these usurpations, the last real Principal of the constitution for the united States was Andrew Jackson after that school was out, but before that the Public is what was against the wall by the actions of the Government, and ever since then the public has always been the only government, they have kept to themselves in true anarchist fashion and left it alone, even today, AS ever, people by overwhelming majority chose to not participate and there is no excuse for the fraud and deception that has happened besides the combination of apathy and anarchy, which with a little bit of consistency could have kept the truth ever evident, but that would have menat to actually Self Govern. It was never free of and for the masses because it was always simply about providing certain services in good faith, and the role of master and servant can never become to resemble the other or be confused!

The only rule of law we have is the people. Poly-tics are a pest that needs constant control, and at best they are faithful servants, but confusing the two is no excuse, because at that point the maxim of law caveat emptor

It is safer to be deceived than to deceive.
A deceiver deals in generals.
Fraud lies hid in general expressions.
A concealed fault is equal to a deceit.
Out of fraud no action arises.
A forestaller is an oppressor of the poor, and a public enemy to the whole community and the country.
It is a fraud to conceal a fraud.
Gross negligence is equivalent to fraud.
Once a fraud, always a fraud.
What otherwise is good and just, if it be sought by force and fraud, becomes bad and unjust.
He is not deceived who knows himself to be deceived.
Let him who wishes to be deceived, be deceived.
He who does not prevent what he can, seems to commit the thing.
He who does not prevent what he can prevent, is viewed as assenting.
He who does not forbid what he can forbid, seems to assent.
He who does not forbid, when he might forbid, commands.
He who does not repel a wrong when he can, induces it.
Often it is the new road, not the old one, which deceives the traveler.
Deceit is an artifice, since it pretends one thing and does another.

Brilliant

Love this. It clearly states many views I have but have struggled expressing.
One of the points you touch on is the concept of an accredited investor.
I feel this one small legal definition needs to be attacked and eliminated from our current legal system.
Eliminating this will go a long way in helping all of us.

The crypto community needs an industry wide organization focused on nothing but lobbying the US government, not for a specific companies best interests, but in the best insterests of us all in a way that follows the principles set for in this post.

Anyone up for forming such an organization?

The government should not segregate people from other parts of the world through their unreal policies because over time cross-breeding has made many Mexicans and canadians to become Americans and vice-versa. So to deny the right of one is to deny the right of all. Thanks
