Invalid Acceptance.
Acceptance is the final expressions of assent in terms of an offer. Acceptance must vary the offer rather an acceptance should be a reflection or minor image of the offer.
Invalid Acceptance.
1. Cross offer.
This is where instead of an offer and an acceptance, the parties make simultaneous or concurrent offer. Cross offer is an example of invalid offer.
2. Concurrent offer.
Thus is when one party varies the original term of the offer.
3. Acceptance ignorance of offer.
A person cannot accept an offer he doesn't know about that's if an offer is made to the general public for specific amount the person who brought that particular thing who was not aware of the offer and the offeror didn't even show interest of revealing his offer.
4. Intention to create legal relation.
While every contract is wan agreement but not every agreement is a contract. The party to a contract must intend to create legal creation because evert contract is an age ment but not every agreement is a contract.
Under the intention to create a legal relation, there are two(2) rebuttable presumptions:
A. Domestic or social arrangement.
This is a rebuttable presumption that there's no intention to create a legal relation. For e.g a man who married his wife wanted to travel and he told his wife a specific amount(30 pounds) to be given yo her on a monthly basis. The man was unable to keep his words so the wife sue the man but the court says there no intention to create a legal relation. An issue of assault between as husband and a wife and the case in court says the law was binding them.
B. Commercial agreement.
There's as presumption that others an intention to create a legal relation unless the contrary is proved.
